IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2009-010 RDA (3110) <br />RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />APPROVING A COOPERATION AGREEMENT BETWEEN THE CITY OF SAN <br />LEANDRO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />FOR THE PURPOSE OF UNDERTAKING REDEVELOPMENT ACTIVITIES WITHIN THE <br />REDEVELOPMENT AREA AT A COST OF $805,000 TO THE REDEVELOPMENT <br />AGENCY FOR THE EDEN ROAD DEVELOPMENT PROJECT, PROJECT NO. 964-82-061, <br />AND APPROPRIATION OF $805,000 <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33421 <br />authorizes a redevelopment agency to cause the acquisition of property for the installation of <br />public improvements necessary in the project area for carrying out the redevelopment plan; and <br />WHEREAS, California Redevelopment Law at Health and Safety Code Section 33445 <br />provides that a redevelopment agency may, with the consent of the legislative body, pay all or a <br />portion of the cost to acquire the property needed for the construction of any building, facility, <br />structure, or other improvements within the project area if it determines all of the following: <br />a. The improvements are of benefit to the project area or the immediate neighborhood <br />in which the project is located; and <br />b. That no other reasonable means of financing the acquisition of property at 2512 <br />Davis Street are available to the community; and <br />c. That the payment of funds for the acquisition will assist in the elimination of one or <br />more blighting conditions inside the project area; and <br />d. The project is consistent with the Five Year Implementation Plan adopted by the <br />Agency pursuant to Section 33490; and <br />WHEREAS, the Redevelopment Agency of the City of San Leandro (the "Agency") is <br />engaged in the Eden Road Development Project within and adjacent to the Redevelopment <br />Project Area ("Project Area"), which will benefit the Project Area by upgrading the appearance <br />of the Project Area; and <br />WHEREAS, no other means of fully financing the acquisition of property for the Eden <br />Road Development Project is available to the community in that the only other possible source of <br />funding is through the use of the City's General Fund, which is pledged for the provision of <br />essential City services for the residents of the City; and <br />
