Lunge, as Trustee of the Lunge Family Trust; Bryan Lucchesi, as Trustee of the <br />Bryan Lucchesi Trust under Declaration of Trust dated August 12, 2002; and, Victor O. <br />Lucchesi, as his sole and separate property (herein "Grantors") and the <br />City of San Leandro, a Charter City (herein "Grantee"). <br />Recitals <br />A. Grantors are the owners in fee simple of an improved parcel of real property <br />located at 1079 MacArthur Boulevard, San Leandro, California and more particularly <br />described as follows: Lot 31, as said lot is shown on the Map of "Meyers-Miller Tract, <br />Subdivision "A" San Leandro CAL., 1912" filed November 12, 1912, in Book 27 of <br />Maps at Page 25, in the Office of the County Recorder of Alameda County, California. <br />This parcel shall be referred to as "Grantors' Property". <br />B. Grantee is desirous of acquiring from Grantors a perpetual, non-exclusive <br />easement under and across the western ten (10) feet of Grantors' Property for purposes of <br />constructing and maintaining a storm drain for disposal of excess water into San Leandro <br />Creek ("Storm Drain Easement"). <br />C. Grantee is also desirous of acquiring from Grantors a perpetual, non-exclusive <br />easement under and across the western ten (10) feet of Grantors' Property for purposes of <br />continuing to use and for the maintenance of the public sanitary sewer line that currently <br />exists on that portion of Grantors' Property ("Sanitary Sewer Line Easement"). <br />D. Grantors have agreed to convey the Storm Drain Easement and the Sanitary <br />Sewer Line Easement to Grantee, as above set forth, and as shown on said Exhibit "A", <br />attached hereto and incorporated herein by reference, upon the terms and conditions set <br />forth in this Agreement.
