The "Facilities" include but not limited to an outfall structure, gabion slope <br />protection and storm drainage pipes. Upon completion of the construction of "Facilities", City <br />will accept the offer of dedication of the "Facilities", and thereafter the City will awn them; <br />NOW THEREFORE, the City agrees as follows: <br />1. All cost for the construction and maintenance of these "Facilities" are the sole expense of <br />the City. <br />2. As part of that maintenance, the City further agrees to regularly inspect the "Facilities" <br />and keep them free from debris/ blockage before and after each storm. The City shall <br />and perform routine maintenance inspections every October of each year. Furthermore, <br />the City shall establish a periodic maintenance program for said "Facilities" in <br />consultation with District. <br />3. After the construction of the "Facilities" is completed, the City shall obtain all necessary <br />encroachment permits from District for any future construction and maintenance of the <br />POO-LD-Hold Harmless indemnicarion 3.07.05 Page 1 of 3 <br />
