,' JD ;~Q ~~ - o ~`J (~ z r~~~ f~~ j .~~~~) MEMORANDUM OF UNDERSTANDING AIRPORT GATEWAY-DOOLITTLE DRIVE STREETSCAPE CONSTRUCTION PROJECT This Memorandum of Understanding concerning the construction of the Airport Gateway stree~~cape improvements along Doolittle Drive (the "MOU") is made on `~LLQ.,c..C.~.- c~"~, '~D~ by and among the City of San Leandro, a municipal corporation ("San Leandro"), the City of Oakland, a municipal corporation ("Oakland"), and the Port of Oakland, a public agency ("Port"), hereafter referred to collectively as the "Parties." Recitals WHEREAS, San Leandro and Oakland have completed and adopted a Joint Revitalization Plan under the Association of Bay Area Governments' Comprehensive Sub-regional Planning Project for the border area shared by each; and WHEREAS, the Parties have adopted an Urban Design Concept for the Airport Gateway Area which incorporates the Airport Gateway--Doolittle Drive Streetscape Improvement Project on Doolittle Drive between approximately 200 feet South of Adams Avenue and Airport Drive (the "Project"); and WHEREAS, portions of the Project area are situated in the respective jurisdictions of the Parties, and the Parties agree that the Project is in the mutual best interest of their respective agencies, and, further, that construction of this Project as a single project is also in their mutual best interest; and WHEREAS, the Parties have agreed to designate City of San Leandro as the Project Administrator and to act on such capacity in behalf of the Parties; and WHEREAS, the Parties have been awarded a fiscal year 2000 HUD Economic Development Initiative Special Project grant of 277 500 for the purpose of funding conceptual design work and preparation of construction documents for the Project, and have previously entered into a memorandum of understanding dated March 9, 2001 (the "Design MOU") in part to facilitate preparation of said construction documents; and WHEREAS, Oakland adopted, on December 3, 2002, a resolution authorizing it to enter into this MOU for the purpose of constructing the Project, and has authorized the contribution of its agreed-upon share of Project costs. San Leandro adopted this MOU on January 5, 2004, by Resolution No. ~-G~~-CC'S ,and has authorized the contribution of its agreed-upon share of Project costs. The Port adopted, on ~C , ,c~G~~, a resolution authorizing it to enter into this MOU for the purpose of constructing the Project, and has authorized the contribution of its agreed upon share of Project costs.
