<br />,' JD ;~Q ~~ - o ~`J <br />(~ z r~~~ f~~ j .~~~~) <br />MEMORANDUM OF UNDERSTANDING <br />AIRPORT GATEWAY-DOOLITTLE DRIVE STREETSCAPE <br />CONSTRUCTION PROJECT <br />This Memorandum of Understanding concerning the construction of the Airport <br />Gateway stree~~cape improvements along Doolittle Drive (the "MOU") is made on <br />`~LLQ.,c..C.~.- c~"~, '~D~ by and among the City of San Leandro, a <br />municipal corporation ("San Leandro"), the City of Oakland, a municipal corporation <br />("Oakland"), and the Port of Oakland, a public agency ("Port"), hereafter referred to <br />collectively as the "Parties." <br />Recitals <br />WHEREAS, San Leandro and Oakland have completed and adopted a Joint <br />Revitalization Plan under the Association of Bay Area Governments' Comprehensive <br />Sub-regional Planning Project for the border area shared by each; and <br />WHEREAS, the Parties have adopted an Urban Design Concept for the Airport <br />Gateway Area which incorporates the Airport Gateway--Doolittle Drive Streetscape <br />Improvement Project on Doolittle Drive between approximately 200 feet South of Adams <br />Avenue and Airport Drive (the "Project"); and <br />WHEREAS, portions of the Project area are situated in the respective jurisdictions <br />of the Parties, and the Parties agree that the Project is in the mutual best interest of their <br />respective agencies, and, further, that construction of this Project as a single project is <br />also in their mutual best interest; and <br />WHEREAS, the Parties have agreed to designate City of San Leandro as the <br />Project Administrator and to act on such capacity in behalf of the Parties; and <br />WHEREAS, the Parties have been awarded a fiscal year 2000 HUD Economic <br />Development Initiative Special Project grant of 277 500 for the purpose of funding <br />conceptual design work and preparation of construction documents for the Project, and <br />have previously entered into a memorandum of understanding dated March 9, 2001 (the <br />"Design MOU") in part to facilitate preparation of said construction documents; and <br />WHEREAS, Oakland adopted, on December 3, 2002, a resolution authorizing it <br />to enter into this MOU for the purpose of constructing the Project, and has authorized the <br />contribution of its agreed-upon share of Project costs. San Leandro adopted this MOU on <br />January 5, 2004, by Resolution No. ~-G~~-CC'S ,and has authorized the contribution <br />of its agreed-upon share of Project costs. The Port adopted, on ~C , ,c~G~~, a <br />resolution authorizing it to enter into this MOU for the purpose of constructing the <br />Project, and has authorized the contribution of its agreed upon share of Project costs. <br />Page 1 of 8 <br />
