IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2003- 007 (1428) <br />RESOLUTION APPROVING THE NEGATIVE DECLARATION FOR THE <br />HOUSING ELEMENT AS PART OF THE COMPREHENSIVE UPDATE OF THE <br />SAN LEANDRO GENERAL PLAN AS COMPLETE AND IN COMPLIANCE WITH <br />THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) REQUIREMENTS <br />WHEREAS, the City Council approved a comprehensive update of the City's <br />General Plan in May 2002, which update included all required elements of the General <br />Plan except for the Housing Element; and <br />WHEREAS, in connection with the aforementioned 2002 General Plan update, <br />the City prepared and the City Council certified an environmental impact report prepared <br />pursuant to the California Environmental Quality Act; and <br />WHEREAS, a proposed update to the Housing Element of San Leandro's General <br />Plan has been presented to the City Council of the City of San Leandro ("City Council"); <br />and <br />WHEREAS, the City Council finds that the proposed Housing Element is entirely <br />consistent with the San Leandro General Plan and does not propose any changes to its <br />land use designations, densities, or development policies; and <br />WHEREAS, the Department of Community Development of the City of San <br />Leandro has prepared and circulated for public review an Initial Study which <br />demonstrates that the proposed Housing Element would have no significant or potentially <br />significant environmental impacts, and a draft Negative Declaration (attached as Exhibit <br />A and incorporated herein by reference) was prepared and circulated for public review; <br />and <br />WHEREAS, the major impacts associated with the proposed Housing Element <br />have already been addressed by the General Plan Update EIR that was certified by the <br />City of San Leandro in May 2002, and, pursuant to Public Resources Code Section <br />21093, the analysis in the attached Initial Study tiers off of the General Plan Update EIR <br />and cross-references the mitigation measures in that document as appropriate; and <br />WHEREAS, no comments were received concerning the Negative Declaration <br />during the public review and comment period; and. <br />WHEREAS, the San Leandro Planning Commission, having conducted a public <br />hearing, and having reviewed the Negative Declaration of environmental impact <br />prepared in connection with the proposed Housing Element at its meeting of January 9, <br />2003, has recommended to the City Council that said Housing Element be approved; and <br />
