~. <br />;.~' <br />ACTIA 2003-I6 <br />AGREEMENT <br />BETWEEN THE <br />ALAMEDA COUNTY TRANSPORTATION IMPROVEMENT AUTHORITY <br />AND THE <br />CITY OF SAN LEANDRO <br />FOR PARATRANSIT OPERATING FUNDS <br />This agreement ("Agreement") is made this first day of July, 2003, by and between the <br />ALAMEDA COUNTY TRANSPORTATION IMPROVEMENT AUTHORITY, a local public <br />agency ("ACTIA"), and the CITY OF SAN LEANDRO, a municipal corporation ("CIT'Y"). <br />RECITALS <br />WHEREAS, the voters of Alameda County, pursuant to the provisions of the Lacal <br />Transportation Authority and lmprovement Act, California Public Utilities Code Section 180000 <br />et seq., approved the reauthorization of Measure B at the General Election held ~on November 7, <br />2000, thereby authorizing that ACTIA be given the responsibility to administer the proceeds <br />from the continued one-half cent transaction and use tax; and <br />WHEREAS, the duration of the tax will be 20 years from the initial year of collection, <br />which began on April 1, 2002, with said tax to terminate/expire on March 31, 2022; and <br />WHEREAS, the one-half cent transaction and use tax proceeds will be used to pay for <br />the programs and projects outlined in Alameda County's 20-Year Transportation Expenditure <br />Plan (hereinafter referred to as "Plan"), as it maybe amended; and <br />WHEREAS, ACTIA will have the authority to bond for the purposes of expediting the <br />delivery of transportation projects and programs, and costs associated with bonding will be borne <br />only by the capital projects included in the Plan and by any programs included in the Plan that <br />utilize the bond proceeds; and <br />WHEREAS, Paratransit funds are provided to cities and transit operators pursuant to the <br />Plan to be used for services aimed at improving mobility for seniors and persons with <br />disabilities; and <br />WHEREAS, the cities and transit operators will annually prepare plans for the utilization <br />of such funds distributed to each entity and administration of paratransit programs in accordance <br />with the Expenditure Plan; and <br />WHEREAS, funds for non-mandated paratransit services are to be distributed to each <br />subarea of the County pursuant to the figures set forth in the Plan; and <br />WHEREAS, based on the plans prepared by the cities and the transit operators, and <br />based on the provisions of the Plan, the Paratransit Advisory and Planning Committee (PAPCO) <br />will annually establish allocation factors for distribution of funds for non-mandated paratransit <br />services within each subarea. subject to the review and approval of the ACTIA Board; and <br />I <br />011455.0001 \610fi 17.3 <br />
