That on or about October 23, 2002, the City of San Leandro, a municipal corporation of the State <br />of California, having offices at 835 East 14th Street, San Leandro, California, did enter into a <br />certain contract with BUGLER CONSTRUCTION, 47000 WARM SPRINGS BLVD., #101, <br />FREMONT, CA 94539 as contractor, for a certain work of improvement: To wit, <br />WASHINGTON AVENUE UNDERPASS SEISMIC RETROFIT, PROJECT NO. 01-210- <br />38-186, of which said City is owner. <br />2. That the name of the surety upon the bond of the Contractor for said work of improvement is as <br />follows: Developers Surety & Indemnity Company. <br />3. That said work of improvement was accepted by the City Council of the City of San Leandro as <br />completed on the 19th day of May 2003. <br />4. The nature of the interest or estate of the City of San Leandro as owner of the WASHINGTON <br />AVENUE UNDERPASS SEISMIC RETROFIT, PROJECT NO. O1-210-38-186, project is <br />that of public right-of--way in certain land designated as Washington Avenue Underpass Bridge as <br />well as ownership of improvements thereon. <br />I certify under penalty of perjury that the foregoing is true and correct.
