,: <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2002 -2 (1851) <br />RESOLUTION APPROVING <br />AMERICAN GOLF CORPORATION RENT CREDIT <br />FOR CONSTRUCTION OVERAGES <br />AT SAN LEANDRO GOLF FACILITY (MONARCH BAY GOLF CLUB) <br />WHEREAS, on November 15, 1997, the City of San Leandro ("City") and American <br />Golf Corporation ("AGC") entered into a Lease Agreement for the renovation and operation of <br />the San Leandro Golf Facility; and <br />WHEREAS, pursuant to the Lease Agreement, AGC has completed the renovation of <br />Monarch Bay Golf Club; and <br />WHEREAS, due to unexpected soil conditions, additional cart paths and high <br />construction prices, the construction resulted in $414,751.24 of additional costs; and <br />WHEREAS, the Lease requires AGC to pay such excess costs and permits AGC to <br />request a credit against the percentage rent provided in the lease; and <br />WHEREAS, the City staff has reviewed all costs and work, and verified all costs. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />TO APPROVE granting American Golf Corporation a percentage rent credit of <br />$414,751.24 for construction overages at San Leandro Golf Facility (Monarch Bay Golf Club). <br />
