IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2002- 21 (1123 ) <br />RESOLUTION CREATING A POLICY TO PROVIDE A <br />SUPPLEMENTAL MII.ITARY LEAVE BENEFIT <br />FOR THE PURPOSE OF CARRYING OUT MILITARY ACTION <br />RESULTING FROM THE SEPTEMBER 11, 2001, TERRORIST ATTACKS <br />RECITALS <br />WHEREAS, employees of the City currently serve as reservists in the United States <br />Armed Forces; and <br />WHEREAS, reservists have been called to active duty as a result of the September 11, <br />2001, terrorist attacks; and <br />WHEREAS, the entire Country is making efforts to support Operation Enduring <br />Freedom, the United States military action resulting from the September 11, 2001, terrorist <br />attacks; and <br />WHEREAS, the City desires to protect its reservist employees from financial hardship <br />resulting from service to their Country by supplementing reservist employees' military pay to an <br />amount equal to what the employee would have received if working as regularly scheduled with <br />the City and continuing other employment benefits that are permissible by contract with the <br />provider for the same time period. <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as <br />follows: <br />1. The City Council of the City of San Leandro hereby adopts a policy supplementing <br />reservist employees' military pay to an amount equal to what the employee would have received <br />if working as regularly scheduled with the City and continuing other employment benefits that <br />are permissible by contract with the provider for the same time period. <br />2. This benefit shall be extended only to those employees who enlisted in the reserves <br />prior to September 11, 2001, and have been called to active duty as a result of Operation <br />Enduring Freedom. <br />3. This benefit shall have a duration of up to twenty-three (23) months. Any employee <br />who does not return to City service within thirty (30) calendar days of being released from active <br />duty and who is physically able to return to work, shall repay, in the form of a loan repayment, <br />the total amount of supplementary military benefit provided. <br />
