Engineering and Transportation Department SUBJECT PROJECT/PROJECT DESCRIPTION RESOLUTION OF AWARD OF CONTRACT TO SPENCON CONSTRUCTION, INC. FOR THE ANNUAL SIDEWALK PROGRAM 2009-10, PROJECT NO. 09-144-36-006 SUMMARY AND RECOMMENDATION This project provides for removal and replacement of damaged concrete sidewalk, driveway approaches, curbs, and gutters throughout the city. Staff recommends award of contract to Spencon Construction, Inc. in the amount $227,250 for the subject project. BACKGROUND Property owners are required by both the State Highway Code and San Leandro Municipal Code to maintain the sidewalks along their frontage. However, the City operates a sidewalk repair program, described in Title 8 of the San Leandro Administrative Code, which repairs sidewalk damage under specific guidelines. Minor defects are ground or patched at no (direct) charge to property owners. Larger defects that require removal and replacement of the concrete are also repaired under the program, but the property owner adjacent to such a defect must reimburse the City for the full construction cost unless a street tree is the cause of damage. Property owners are only responsible to pay for half the construction cost for damage caused by a street tree. Analysis A total of three (3) bids were received on August 17, 2009. The bids ranged from $227,250 to $273,350, with Spencon Construction, Inc. submitting the lowest bid in the amount of $227,250, which has been determined to be a responsive bid.
