IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2009-008 (1413) <br />AN ORDINANCE AMENDING TITLE 4, CHAPTER 4-19 OF THE SAN LEANDRO <br />MUNICIPAL CODE TO ADD NEW SECTIONS 4-19-135, 4-19-140, 4-19-145, AND 4-19- <br />150 RELATING TO RULES AND REGULATIONS FOR USE OF THE WES MCCLURE <br />BOAT LAUNCH RAMP AT THE SAN LEANDRO MARINA <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1. Amendment of Code. <br />Title 4, Chapter 4-19 of the San Leandro Municipal Code is amended to add new sections <br />as follows: <br />4-19-135 DEPOSIT OF FEES. Prior to launching a boating vessel via a trailer <br />from the Wes McClure Boat Launch, whether the vessel is motorized or not, any person shall <br />have a current yearly launch permit or deposit the required daily launch fee in the payment kiosk. <br />Yearly permit holders (year is from July 1 -June 30) shall display the permit from the rearview <br />mirror of their vehicle. Daily permit holders shall clearly display the permit on the dashboard of <br />their vehicle with the trailer's license plate number and the date of purchase noted on the permit. <br />4-19-140 BOAT LAUNCH FEES. The boat launch fee for the Wes McClure Boat <br />Launch shall be in conformance with the latest adopted City Fee Schedule. <br />4-19-145 USE OF REVENUE. The revenue raised by the collection of boat launch <br />fees shall be paid into the treasury of the City of San Leandro, and shall be used for costs of <br />installation and maintenance of the launch ramp facility; costs of regulation of launching, and <br />other related costs. <br />4-19-150 AUTHORITY TO CITE. The City Manager and his/her designee(s) <br />shall have the authority to issue citations for non-payment of the established boat launch fee. <br />Section 2. Effective Date and Publication. <br />This ordinance shall take effect thirty (30) days after adoption. The City Clerk is directed <br />to publish the title once and post a complete copy thereof on the City Council Chamber bulletin <br />board for five (5) days prior to adoption. <br />Section 3. Severability. <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of the <br />ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any court of <br />competent jurisdiction, such decision shall not affect the validity or effectiveness of the <br />
