Hollister <br />City Manager <br />Debbie Pollart, Facilities & Open Space Manager <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />MATTER OF RESOLUTION AMENDING TITLE 6, CHAPTER 4, SECTION 6.4.100 OF <br />THE SAN LEANDRO ADMINISTRATIVE CODE ADDING FINE FOR BOAT LAUNCH <br />RAMP VIOLATION. <br />SUMMARY AND RECOMMENDATION <br />Staff recommends that the City Council adopt a resolution amending the City's fee schedule, <br />adding a fine for boat launch ramp violations. <br />BACKGROUND <br />In June of 2009, the City Council approved a new boat launch fee for the Wes McClure Boat <br />Launch. This fee is not a parking fee, meaning that vehicles without trailers may continue to park <br />in the lot free of charge. The fee is specifically for launching of trailered boats. <br />DISCUSSION <br />Starting July 7, 2009, staff installed signage and an un-manned pay kiosk and has been selling <br />both daily and yearly launch permits at the Harbor Master's Office. As of September 21, the City <br />had received $1,800 from the purchase of 18 yearly permits plus $2550 from 255 daily permits. <br />This total of $4,350 in launch fees exceeds the materials and associated start-up costs of $2,516. <br />As this is an entirely new fee and not a parking fee (which is covered under Municipal Code <br />Chapter 6-1), the Municipal Code does not currently provide citation authority for staff, nor is <br />there an established violation fine. Currently, courtesy letters are left on vehicles that are found <br />to not have obtained a launch permit, but there is no fine if people do not pay. The proposed new <br />language in Ordinance 2009-008 establishes the citation authority. The proposed amendment to <br />the City's Fee Schedule (Administrative Code) would establish a new $50 fine for failure to <br />display either a daily or annual launch permit. <br />Current City Council Policy <br />N/A <br />
