IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2009.009 (1197) <br />AN ORDINANCE AMENDING TITLE 3, CHAPTER 3.2 OF THE SAN LEANDRO MUNICIPAL CODE <br />RELATED TO WEED ABATEMENT <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />Section 1. Title 3, Chapter 3-2, Article 1. is amended to add the following new sections: <br />3.2.102 ADMINISTRATIVE HEARING BODY <br />"Administrative Hearing Body" shall mean three (3) City of San Leandro department manager level <br />employees designated by the City Manager to hear and decide upon together, administrative enforcement <br />cases under this Chapter. <br />3.2.103 LIS PENDENS <br />"Lis Pendens," which may also be known as a "Certificate of Nuisance," is a written notice drafted by <br />staff that is recorded against a property to notify property owners, and bona fide purchasers of property for <br />value that an action and fine under this Chapter was recorded against a property. Such lis pendens shall not <br />supersede, but shall be in addition to, at the discretion of the Enforcement Official, any lien or special <br />assessment recorded upon a property pursuant to enforcement of this Chapter's provisions. <br />Section 2. Section 3.2.210 is amended in its entirety to read as follows: <br />Any property within the City of San Leandro maintained in violation of this Chapter is hereby declared <br />to be a public nuisance, and such violation shall be abated in the manner provided in this Chapter. <br />Section 3. Title 3, Chapter 3.2, Article 2. is amended to add the following new sections: <br />3.2.235 ADMINISTRATIVE ENFORCEMENT OF VIOLATIONS UNDER THIS CHAPTER <br />Any Enforcement Officer shall have the authority to gain compliance with all provisions of this Chapter. <br />These powers include the power to issue a notice of violation, as described below in Section 3-2-240, the <br />power to inspect public and private property, and to seek and employ whatever remedies are available under <br />this Chapter and this Municipal Code not specifically mentioned herein. <br />3.2.240 NOTICE OF VIOLATION <br />(a) Subject to subsection (e) below, whenever an Enforcement Officer finds that a provision of <br />this Chapter has been violated, and such officer determines to pursue administrative enforcement of the <br />violation pursuant to this Chapter, he or she shall issue the responsible party a written notice of the violation <br />either imposing a penalty or ordering the responsible party to appear at a hearing and show cause why such <br />
