IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE N0.2009.009 (1197) AN ORDINANCE AMENDING TITLE 3, CHAPTER 3.2 OF THE SAN LEANDRO MUNICIPAL CODE RELATED TO WEED ABATEMENT The City Council of the City of San Leandro does ORDAIN as follows: Section 1. Title 3, Chapter 3-2, Article 1. is amended to add the following new sections: 3.2.102 ADMINISTRATIVE HEARING BODY "Administrative Hearing Body" shall mean three (3) City of San Leandro department manager level employees designated by the City Manager to hear and decide upon together, administrative enforcement cases under this Chapter. 3.2.103 LIS PENDENS "Lis Pendens," which may also be known as a "Certificate of Nuisance," is a written notice drafted by staff that is recorded against a property to notify property owners, and bona fide purchasers of property for value that an action and fine under this Chapter was recorded against a property. Such lis pendens shall not supersede, but shall be in addition to, at the discretion of the Enforcement Official, any lien or special assessment recorded upon a property pursuant to enforcement of this Chapter's provisions. Section 2. Section 3.2.210 is amended in its entirety to read as follows: Any property within the City of San Leandro maintained in violation of this Chapter is hereby declared to be a public nuisance, and such violation shall be abated in the manner provided in this Chapter. Section 3. Title 3, Chapter 3.2, Article 2. is amended to add the following new sections: 3.2.235 ADMINISTRATIVE ENFORCEMENT OF VIOLATIONS UNDER THIS CHAPTER Any Enforcement Officer shall have the authority to gain compliance with all provisions of this Chapter. These powers include the power to issue a notice of violation, as described below in Section 3-2-240, the power to inspect public and private property, and to seek and employ whatever remedies are available under this Chapter and this Municipal Code not specifically mentioned herein. 3.2.240 NOTICE OF VIOLATION (a) Subject to subsection (e) below, whenever an Enforcement Officer finds that a provision of this Chapter has been violated, and such officer determines to pursue administrative enforcement of the violation pursuant to this Chapter, he or she shall issue the responsible party a written notice of the violation either imposing a penalty or ordering the responsible party to appear at a hearing and show cause why such
