IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE N0.2009-010 (2648/2660) <br />AN URGENCY ORDINANCE AMENDING TITLE 3, SECTION 3-4-124 OF THE SAN <br />LEANDRO MUNICIPAL CODE RELATED TO REVIEW OF PROCLAMATION OF A <br />LOCAL EMERGENCY <br />RECITALS <br />WHEREAS, following the declaration of a local emergency, the City of San Leandro is <br />required by State law to periodically review the need for continuing the local emergency; and <br />WHEREAS, the San Leandro Municipal Code provides that the City Council must review <br />the need for continuing a local emergency at least every fourteen (14) days; and <br />WHEREAS, the California Emergency Services Act states that the local governing body <br />shall review, at its regularly scheduled meetings until the local emergency is terminated, the need <br />for continuing the local emergency. However, in no event shall a review take place more than <br />twenty-one (21) days after the previous review; and <br />WHEREAS, it is in the best interest of the City to amend the City's Municipal Code to <br />conform to the requirements of state law to enable the City to timely respond to, act and preserve <br />the public peace, health ,safety and welfare of the City in the event of a local emergency; <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />SECTION L FINDINGS. The City Council of the City of San Leandro does hereby find <br />as follows: <br />A. The City Council hereby finds that there continues to be a current and immediate threat <br />to the public peace, health, safety and welfare of its citizens for the following reason: <br />(1) That a public health emergency exists due to the epidemic of the H1N1 <br />Influenza. <br />B. For the reasons set forth above and in the recitals of this Ordinance, the City Council <br />further finds that immediate passage of this Ordinance is necessary to protect the public health, <br />safety, and welfare. <br />SECTION 2. AMENDMENT OF CODE. Title 3, Section 3-4-124(c) of the San <br />Leandro Municipal Code is hereby amended as follows: <br />
