Hollister, City Manager ~ <br />FROM: Luke Sims, Conm~unity Development Direct6r' <br />BY: Philip Millenbah, Senior Planner <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />APPROVED AND FORWARDED <br />TO CITY COUNCIL <br />~~~ <br />Stephen L.Hollister <br />City Manager <br />MATTER OF AMENDMENT TO THE SAN LEANDRO ZONING CODE TO AMEND <br />ARTICLES 3 AND 7 RELATIVE TO DISCOUNT SUPERSTORES <br />SUMMARY AND RECOMMENDATION <br />On December 17, 2009 the Planning Commission held a public hearing to review a draft "big box" <br />retail ordinance relative to discount superstores and pedestrian-oriented retail. At the hearing the <br />Planning Commission addressed several issues and recommended approval of the ordinance <br />subject to further amendment prior to forwarding the ordinance to the City Council. This item was <br />noticed for the City Council consideration at the meeting of January 19, 2010. However, due to the <br />complexity of the proposed ordinance and the continents received from the Commission, staff is <br />not prepared to present a recommendation at this time. Therefore, we respectfully request that the <br />matter be continued until staff has fully researched the matter and can prepare a recon-imendation <br />that addresses the Plannn~g Commission Comments. Staff is proposing meeting with interested <br />parties, including the California Retailers Association, the San Leandro Chamber of Commerce, <br />and labor representatives before proceeding back to the City Council with recommend changes. <br />Staff recommends that the City Council move to postpone the public hearing on the proposed <br />Big Box Ordinance to a future Council meeting. <br />BACKGROUND <br />Staff is not prepared to present a background report at this time. <br />CONCLUSION <br />To fully respond to the complex zoning issues raised by the Planning Commission, staff is in need <br />of additional time to prepare the proposed Zoning Code amendments. Staff recommends the matter <br />be postponed and that a new hearing be scheduled once staff has had the opportunity to address <br />continents regarding the proposed amendments and has been able to conduct further outreach <br />efforts with interested parties. <br />
