RECORDING REQUESTED BY: <br />AND'WHEN` RECORDED MAIL TO: <br />Redevelopment Agency of the <br />City of San Leandro <br />835 East 14th Street <br />San Leandro, California 94577 <br />2,y Of ALAS 2010116399 0412812010 03.05 PIS <br />pl ~ `~o OFFICIAL RECORDS OF ALAMEDA COUNTY <br />{ ~ ' PATRICK O'CONNELL ®.00 <br />~~, RECORDING FEE: <br />C~UFOPN,4 <br />~~ I I 3 PG5 <br />1 <br />Recording without fee pursuant to Section 27383 of the Government Code <br />REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />CERTIFICATE OF COMPLETION <br />This Certificate of Completion for the Creekside Plaza Office Complex is being <br />executed by the Redevelopment Agency of the City of San Leandro, a public body <br />corporate and politic (the "Agency") with reference to the following: <br />1 The Agency and Creekside Associates, LLC heretofore entered into that <br />certain Amended and Restated Disposition and Development Agreement (the "DDA") <br />date July 17, 2000, a copy of which is recorded with the County of Alameda (Instrument <br />Series No. 2001-161041) and is on file with the Agency Secretary. <br />2 Subsequent to the execution of the DDA, the Agency executed a Consent <br />Agreement dated April 25, 2001 consenting to the establishment of undivided fifty <br />percent (50%) interests in the ownership of the property with Creekside Associates LLC <br />owned entirely by David C. Irmer, and T. Lawrence Jett, a married man as his sole and <br />separate property (hereinafter the "Developer"). <br />3 Section 4.10 of said DDA provides that upon completion of the Developer <br />Improvements, the Agency will issue a Certificate of Completion certifying that the <br />construction of the Developer Improvements has been completed. Such Certificate of <br />Completion shall be in such form as to enable it to be recorded in the official records of <br />Alameda County. <br />4 The Developer has notified the Agency and the Agency hereby <br />acknowledges that the Developer has completed the following components of the <br />Developer Improvements: (a) a portion of the Minimum Office Improvements consisting <br />of one approximately 100,000 square foot office building (commonly referred to as <br />Building "A") on Parcel B of Parcel Map 7758 (which constitutes satisfactory completion <br />of all Developer Improvements on Parcel B); (b) a portion of the Minimum Office <br />Improvements consisting of one approximately 50,000 square foot office building <br />(commonly referred to as Building "C") on Parcel C of Parcel Map 7758 (which <br />constitutes satisfactory completion of all Developer Improvements on Parcel C); <br />(c) a parking garage and landscaping improvements on Parcel D of Parcel Map 7758; <br />(d) all of the Adjacent City Property Improvements; (e) all of the Condominium <br />Benefiting Improvements; and (f) the final portion of the Minimum Office Improvements <br />consisting of one approximately 85,000 square foot office building (commonly referred <br />to as Building "B") <br />PKNS~325498.1 <br />
