<br />IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2001 - 10 (2888) <br />A RESOLUTION OF THE REDEVELOPMENT AGENCY ADOPTING A M ITIGATED NEGATIVE <br />DECLARATION AND FINDINGS RELATED THERETO FOR APPROVAL OF DISPOSITION <br />AND DEVELOPMENT AGREEMENTS FOR THE DEVELOPMENT OF THE PROPERTY <br />LOCATED AT 467 (APN 075-0087-003-02), 505 (APN 075-0087-004-04), 517 (APN 075-0087- <br />004-06), 559 (APN 075-0087-007-04), 575 (APN 075-0087-006-06), 635 (APN 075-0093-007- <br />02), AND 765 (APN 075-0093-001-02) MARINA BOULEVARD, AND AN OWNER <br />PARTICIPATION AGREEMENT FOR 936 (APN 075-0102-008-02) MARINA BOULEVARD. <br />RECITALS <br />WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") has <br />negotiated Disposition and Development Agreements ("DDAs") and an Owner Participation <br />Agreement ("OPA°) for acquisition and sale of property to be used for automobile dealerships <br />(collectively, the "Project"); and <br />WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared pursuant <br />to the requirements of the Califomia Environmental Quality Act in August of 2001 and circulated <br />for public review from August 17,2001 to September 17, 2001; and <br />WHEREAS, the Agency has received and reviewed copies of the Initial Study, the <br />Mitigated Negative Declaration, and comments thereon; and <br />WHEREAS, the Agency has received and reviewed copies of a Mitigation Monitoring <br />Plan for the Project prepared by the Agency. <br />NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro does <br />resolve as follows: <br />Section 1. That, pursuant to the California Environmental Quality Act, the Agency makes <br />the following findings: <br />a. The Agency has conducted an independent analysis of the adequacy of the proposed <br />Mitigated Negative Declaration. <br />b. The Mitigation Monitoring Plan sets forth an adequate program for reporting on and <br />monitoring the mitigation measures which the Agency has required to mitigate or avoid <br />significant environmental effects. <br />c. The development permitted as a result of the DDAs and the OPA will not have a <br />significant effect on the environment in the following areas: Land Use, Population and Housing, <br />Geology and Soils, Hydrology and Water Quality, Air Quality Biological Resources, Mineral <br />Resources, Noise, Transportation/Circulation, Public Services, Utilities and Service Systems, <br />Recreation, Aesthetics, and Agricultural Resources. <br />d. The Agency finds that, on the basis of the following specific findings, the development <br />
