IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 2001- 07 (1035/1076/2439) <br /> AN ORDINANCE ADDING TITLE 111, CHAPTER 17 <br /> TO THE SAN LEANDRO MUNICIPAL CODE RELATING TO <br /> CERTIFIED UNIFIED PROGRAM AGENCY (CUPA), <br /> AND ADDING TITLE Ill, CHAPTER 18 TO THE SAN LEANDRO MUNICIPAL CODE <br /> RELATING TO ENFORCEMENT OF ENVIRONMENTAL REGULATIONS <br /> WHEREAS, Chapter 6.1 1, Section 25404 of the California 1- lealth and Safety Code <br /> provides that every County and City, upon certification by Cal -EPA, shall implement the <br /> provisions of the Certified Unified Program Agency (CUPA) as to the handling of hazardous <br /> materials and waste in the County, and also authorizes a City, pursuant to CUPA certification, to <br /> assume responsibility by ordinance or resolution for the implementation of CUPA regulations <br /> and programs within the City; and <br /> WHEREAS, Chapter 6.11 further provides that in the event a City assumes responsibility <br /> for the administration and enforcement of CUPA, it shall have exclusive jurisdiction within the <br /> boundaries of the City for the purpose of implementing the CUPA programs; and <br /> WHEREAS, Chapter 6.11 authorizes each administering County or City upon a majority <br /> vote of its governing body to adopt a schedule of fees to be collected from each business within <br /> its jurisdiction that is required to submit a CUPA Registration and Permit application, and <br /> provide that such fees shall be set in an amount sufficient to pay only those costs incurred by the <br /> County or City in carrying out its role as CUPA; and <br /> WFIEREAS, the California Environmental Protection Agency has certified the City of <br /> San Leandro so that it may assume responsibility for the administration and enforcement of the <br /> CUPA programs, with the exception that the Alameda County District Attorney shall retain <br /> responsibility for prosecution of violations of the CUPA program elements; <br /> WHEREAS, the City of San Leandro has recently formed the City of San Leandro <br /> Environmental Services Division and wishes to ensure that the enforcement and administration <br /> of environmental issues are consolidated into one department as efficiently as possible; <br /> WHEREAS, the City of San Leandro wishes to consolidate all of the enforcement <br /> provisions involving environmental regulations into one Chapter to improve efficiency and <br /> public awareness; now therefore <br /> 1 <br />
