IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2001 - 015 (1428/1099/1024) <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />REPEALING THE EXISTING SAN LEANDRO ZONING CODE ADOPTED DECEMBER 27, 1995, AND <br />ADOPTING THE PROPOSED SAN LEANDRO ZONING CODE, DATED JULY 2, 2001 <br />RECITIALS <br />WHEREAS, In 1999 and 2000, the San Leandro City Council indicated a desire to review several <br />specific land use and development regulations; and <br />WHEREAS, In September 1999, the City Council received the report and recommendations of the <br />West San Leandro Advisory Committee, which recommended changes to the City's Industrial land use <br />regulations. <br />WHEREAS, on February 22. 2000, the City Council enacted Ordinance No. 2000-03, a temporary <br />moratorium on the establishment of new businesses devoted primarily to the sale or exchange of tobacco <br />related products to allow the City to study new zoning regulations concerning such businesses; and <br />WHEREAS, in August 2000, a joint study session by the BZAIPC was held to discuss possible <br />industrial zoning changes, followed in September 2000 by another joint study session to consider possible <br />changes in residential zones, and, thereafter, several meetings were held with community groups, as well <br />as meetings with the City Council and the Council's Large Homes and Additions subcommittee for the <br />purpose of updating the Council and staffs progress and to receive input on various zoning proposals; and <br />WHEREAS, in February 2001, the proposed draft zoning revisions were referred to the San <br />Leandro Board of Zoning Adjustment, and on February 15, 2001, that Board recommended to the San <br />Leandro Planning Commission approval of the draft, along with certain additional suggestions; and <br />WHEREAS, in March of 2001, the Planning Commission received that recommendation, and <br />began consideration of the proposed draft zoning revisions; and <br />WHEREAS, at its first hearing to consider the draft, the Planning Commission directed staff to <br />conduct further community meetings with respect to certain aspects of the draft, and, thereafter, staff met <br />with various community groups to review the draft zoning revisions; and <br />WHEREAS, on April 16, 2001, the City Council enacted Ordinance No. 2001-012, a temporary <br />moratorium on the construction of second story residential additions in the Bayo Vista neighborhood to <br />allow the City to study zoning regulations concerning such construction, which moratorium was <br />subsequently extended by adoption of Ordinance No. 2001-014, on May 21, 2001; and <br />WHEREAS, the Planning Commission held several additional study sessions to carefully review <br />the provisions of the draft and consider additional input from the community, and thereafter, on May 24, <br />2001, after holding a second noticed public hearing to consider the proposed draft zoning revisions, <br />adopted a recommendation to the City Council approving the draft, along with certain proposed changes; <br />and <br />
