IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 99 -022 (1076) <br /> AN URGENCY ORDINANCE REPEALING ARTICLE 12 <br /> AND ADDING ARTICLE 12 TO CHAPTER 5 <br /> OF TITLE VII OF THE SAN LEANDRO MUNICIPAL CODE, <br /> ADOPTING BY REFERENCE ENFORCEMENT AND ABATEMENT - APPEALS, <br /> AS AMENDED, AND MAKING THIS MATTER AN URGENCY MEASURE TO TAKE <br /> EFFECT JULY 1, 1999, PURSUANT TO SECTION 1 -1 -345 (f) AND (b) OF <br /> THE SAN LEANDRO MUNICIPAL CODE BECAUSE IT RELATES TO PARTICULAR <br /> PROVISIONS OF LAW PRESCRIBING THE MANNER OF ITS PASSAGE AND <br /> ADOPTION AND FOR THE IMMEDIATE PRESERVATION OF THE PUBLIC PEACE, <br /> HEALTH OR SAFETY <br /> The City Council of the City of San Leandro does ORDAIN as <br /> follows: <br /> Section 1. Article 12 of Chapter 5 of Title VII of the <br /> San Leandro Municipal Code is hereby repealed. <br /> Section 2. Article 12 is hereby added to Chapter 5 of <br /> Title VII of the San Leandro Municipal Code to read as follows: <br /> "ARTICLE 12. ENFORCEMENT AND ABATEMENT APPEALS <br /> Section 7 -5 -1200: RIGHT TO APPEAL FROM NOTICE AND ORDER OF <br /> THE BUILDING OFFICIAL: BOARD OF APPEALS. Any person aggrieved by <br /> a notice and order of the Building Official hereunder to repair, <br /> vacate and repair, or demolish any building or portion thereof, <br /> may appeal such order, in the manner stated in Section 7 -5 -1210, <br /> to the Board of Appeals. <br /> Section 7 -5 -1205: ORDER OF BUILDING OFFICIAL FINAL AND <br /> CONCLUSIVE. Whenever a notice and order has been issued by the <br /> Building Official and served as provided in Section 7 -5 -1135 and <br /> no appeal has been filed in accordance with Section 7 -5 -1210, the <br /> notice and order shall be deemed final and conclusive. <br /> Section 7 -5 -1210: PROCEDURE FOR FILING AN APPEAL FROM <br /> NOTICE ORDER OF THE BUILDING OFFICIAL. Any person entitled to <br /> service under Section 7 -5 -1135 may appeal from any notice and <br /> order or any action of the Building Official by filing a written <br /> appeal therefrom at the office of the Building Official within <br /> ten (10) days from the date of service of such notice and order. <br /> 1 <br />
