IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 98 -011 (1413/1099/1024) <br /> AN ORDINANCE OF THE SAN LEANDRO CITY COUNCIL <br /> AMENDING THE SAN LEANDRO MUNICIPAL CODE BY ADDING <br /> TITLE IV, CHAPTER 24 RELATING TO THE REGULATION OF ADULT - <br /> ORIENTED BUSINESSES <br /> The City Council of the City of San Leandro does hereby ORDAIN as follows: <br /> SECTION 1: In order to protect the public health, safety, and general <br /> welfare of the community, the City of San Leandro desires to add Tide IV, Chapter <br /> 24 to the Municipal Code related to Adult- Oriented Businesses to ensure that such <br /> businesses are properly sited and regulated in a manner consistent with applicable <br /> provisions of the law; and <br /> The Planning Commission advertised and conducted public meetings and <br /> public hearings as prescribed by law on June 25, 1998 and July 23, 1998, at which <br /> time the Planning Commission recommended adoption of the ordinance; and <br /> The City Council considered evidence presented by the Planning Commission <br /> and other interested parties at duly advertised public hearings on September 8, 1998, <br /> and September 22, 1998; and <br /> The City Council finds that this ordinance is enacted in order to mitigate the <br /> threat posed to the public peace, health, or safety by Adult- Oriented Businesses. In <br /> this regard, the findings set forth in this Ordinance are incorporated herein by <br /> reference. This ordinance provides for the amendment of existing regulations <br /> applicable to Adult - Oriented Business uses. The changes to the Municipal Code <br /> required the completion of an Initial Study to comply with the California <br /> Environmental Quality Act. The conclusion of the Initial Study was that the project <br /> will not have a significant effect on the environment and a Negative Declaration was <br /> prepared. <br /> SECTION 2: Studies and information reviewed at that meeting and <br /> fonvarded by the Planning Commission revealed the following facts: <br /> (a) The adverse secondary side effects of Adult- Oriented Businesses have been <br /> 1 <br />
