1 n <br /> IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 97 - 014 (1413) <br /> AN ORDINANCE ADDING ARTICLE 2, CHAPTER 3, <br /> TITLE VI, TO THE SAN LEANDRO MUNICIPAL CODE <br /> PROHIBITING SITTING OR LYING ON PUBLIC <br /> SIDEWALKS IN COMMERCIAL AND RETAIL AREAS <br /> The City Council of the City of San Leandro does ORDAIN as follows: <br /> Section 1. Article 2 is hereby added to Chapter 3, Title VI of the San <br /> Leandro Municipal Code to read as follows: <br /> • "ARTICLE 2. LYING ON PUBLIC SIDEWALKS <br /> Section 6 -3 -200: PURPOSE - DEFINITION. <br /> The purpose of this article is to facilitate the safe and efficient movement of <br /> pedestrians and goods on the public sidewalks and in retail and commercial areas of <br /> the City. For purposes of this Article the term "public sidewalk" shall mean and <br /> include all areas within the public right -of -way commonly and customarily used for <br /> pedestrians and for ingress and egress of business and commercial establishments <br /> fronting the public right -of -way and to public parking areas, lots and structures. <br /> Section 6 -3 -210: PROHIBITION • <br /> No person, after having been notified by a law enforcement officer that he or <br /> she is in violation of the prohibition of this section, shall sit or lie down upon a public <br /> sidewalk, or upon a blanket, chair, stool, or any other object placed upon a public <br /> sidewalk in a commercial or retail zone, during the hours between 7:00 a.m. and 9:00 <br /> p.m. <br /> Section 6 -3 -220: EXCEPTIONS <br /> The prohibition in Section 6 -3 -210 shall not apply to any person: <br /> (a) sitting or lying down on a public sidewalk due to a medical <br /> emergency; <br /> •(b) who, as the result of a disability, utilizes a wheelchair, walker, or <br /> similar devices to move about the public sidewalk; <br />
