1 n IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ORDINANCE NO. 97 - 014 (1413) AN ORDINANCE ADDING ARTICLE 2, CHAPTER 3, TITLE VI, TO THE SAN LEANDRO MUNICIPAL CODE PROHIBITING SITTING OR LYING ON PUBLIC SIDEWALKS IN COMMERCIAL AND RETAIL AREAS The City Council of the City of San Leandro does ORDAIN as follows: Section 1. Article 2 is hereby added to Chapter 3, Title VI of the San Leandro Municipal Code to read as follows: • "ARTICLE 2. LYING ON PUBLIC SIDEWALKS Section 6 -3 -200: PURPOSE - DEFINITION. The purpose of this article is to facilitate the safe and efficient movement of pedestrians and goods on the public sidewalks and in retail and commercial areas of the City. For purposes of this Article the term "public sidewalk" shall mean and include all areas within the public right -of -way commonly and customarily used for pedestrians and for ingress and egress of business and commercial establishments fronting the public right -of -way and to public parking areas, lots and structures. Section 6 -3 -210: PROHIBITION • No person, after having been notified by a law enforcement officer that he or she is in violation of the prohibition of this section, shall sit or lie down upon a public sidewalk, or upon a blanket, chair, stool, or any other object placed upon a public sidewalk in a commercial or retail zone, during the hours between 7:00 a.m. and 9:00 p.m. Section 6 -3 -220: EXCEPTIONS The prohibition in Section 6 -3 -210 shall not apply to any person: (a) sitting or lying down on a public sidewalk due to a medical emergency; •(b) who, as the result of a disability, utilizes a wheelchair, walker, or similar devices to move about the public sidewalk;
