IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 96- 05 (2690/1413) <br /> AN ORDINANCE ADDING CHAPTER 5 OF TITLE II <br /> OF THE SAN LEANDRO MUNICIPAL CODE. TO ESTABLISH <br /> PROCEDURES RELATED TO FORMATION OF <br /> MAINTENANCE ASSESSMENT DISTRICTS AND, PURSUANT TO <br /> S.L.M.C. SECTION 1 -1 -345, DECLARING THIS ORDINANCE TO TAKE <br /> EFFECT IMMEDIATELY BECAUSE IT RELATES <br /> TO PUBLIC IMPROVEMENT PROCEEDINGS <br /> RECITALS <br /> WHEREAS, Robert's Landing Incorporated, dba Citation Homes Central, has <br /> received land use approval to construct a residential development at the Robert's Landing <br /> area; <br /> WHEREAS, said land use approvals included a general development plan which <br /> included condition no. XW related to the formation and implementation of an <br /> assessment district to maintain various public improvements required as conditions of <br /> approval to the Robert's Landing residential development; <br /> bVHEREAS, maintenance of said public improvements including, but not limited <br /> to, the Citation Marsh, the stormwater detention ponds, the stormwater pump, the buffer <br /> areas including improvements thereon, certain public streets and improvements thereon, <br /> and the funding of the annual payment for maintenance of items in the City of San <br /> Leandro Water Circulation and Drainage Plan area, all of which require formation of a <br /> maintenance assessment district; <br /> WHEREAS, efficient operation and formation of the assessment district warrants <br /> creation of a local maintenance assessment district procedure; <br /> NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN <br /> as follows: <br /> Section 1.
