IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 96 - 06 (1024) <br /> AN INTERIM ORDINANCE PROHIBITING THE <br /> PROCESSING AND APPROVAL OF USE PERMITS, VARIANCES, <br /> BUILDING PERMITS, OR OTHER ZONING ENTITLEMENTS <br /> FOR ADULT ENTERTAINMENT ESTABLISHMENTS WHICH MAY <br /> CONFLICT WITH PROPOSED ZONING ORDINANCES AND ZONING MAP <br /> AMENDMENTS AND DECLARING THIS ORDINANCE TO BE AN URGENCY <br /> MEASURE NECESSARY FOR THE PRESERVATION OF PUBLIC PEACE <br /> HEALTH AND SAFETY <br /> RECITALS <br /> A. In October of 1995, the City Council adopted a revised zoning ordinance <br /> and a revised zoning map for the entire City. <br /> B. The City acknowledged at that time that is was not possible to anticipate <br /> and address every circumstance or situation that may arise. <br /> C. Since that time, changes in the interpretation of the First Amendment <br /> require the City to re- examine zoning ordinances and the zoning map with regard to <br /> adult businesses. <br /> NOW, THEREFORE, die City Council of the City of San Leandro does ORDAIN <br /> as follows: <br /> Section I. Pursuant to Government Code section 65858, the City Council of <br /> the City of San Leandro does hereby find as follows. <br /> A. The City Council hereby finds that for the following reasons there <br /> is a current and immediate threat to the public peace, health, safety and welfare of its <br /> citizens: <br /> (1) The Adult Entertainment Establishment uses listed in this <br /> ordinance are subject to additional regulation which is under consideration by the City. <br />
