• <br /> IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 96 - 08 (1024/1099) <br /> AN INTERIM ORDINANCE PROHIBITING <br /> THE PROCESSING AND APPROVAL OF USE PERMITS, <br /> VARIANCES, BUILDING PERMITS, OR <br /> OTHER ZONING ENTITLEMENTS FOR <br /> ADULT ENTERTAINMENT ESTABLISHMENTS <br /> WHICH MAY CONFLICT WITH PROPOSED <br /> ZONING ORDINANCES AND ZONING MAP AMENDMENTS <br /> AND DECLARING THIS ORDINANCE TO BE <br /> AN URGENCY MEASURE NECESSARY FOR <br /> THE PRESERVATION OF PUBLIC PEACE, <br /> HEALTH AND SAFETY <br /> RECITALS <br /> A. In October of 1995, the City Council adopted a revised zoning <br /> ordinance and a revised zoning map for the entire City. <br /> B. The City acknowledged at that time that is was not possible to <br /> anticipate and address every circumstance or situation that may arise. <br /> C. Since that time, changes in the interpretation of the First Amendment <br /> require the City to re- examine zoning ordinances and the zoning map with regard to <br /> adult businesses. <br /> D. In May of 1996, the City Council adopted a forty -five (45) day interim <br /> urgency ordinance prohibiting the processing and approval of use permits, variances, <br /> building permits, or other zoning entitlements for adult entertainment establishments <br /> because such actions may conflict with proposed zoning ordinances and zoning map <br /> amendments. <br /> E. The City Council acknowledges that it needs additional time to study <br /> this matter and prepare the necessary recommendations. <br /> 1 <br /> • <br />
