IN THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2010 -009 RDA <br /> A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF SAN <br /> LEANDRO APPROVING A COOPERATION AGREEMENT BETWEEN THE CITY OF <br /> SAN LEANDRO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN <br /> LEANDRO FOR THE PURPOSE OF UNDERTAKING REDEVELOPMENT ACTIVITIES <br /> WITHIN THE PLAZA PROJECT AREA AT A COST NOT TO EXCEED ELEVEN MILLION <br /> FOUR HUNDRED AND FIFTY THOUSAND DOLLARS ($11,450,000) TO THE <br /> REDEVELOPMENT AGENCY, AUTHORIZING THE EXPENDITURE OF TAX <br /> INCREMENT FUNDS FOR PUBLIC IMPROVEMENTS AND PUBLIC FACILITIES, AND <br /> ADOPTING FINDINGS REQUIRED BY HEALTH AND SAFETY CODE SECTION 33445.1 <br /> WHEREAS, by Ordinance No. 93 -012, the City Council and the Redevelopment <br /> Agency of the City of San Leandro (the "Agency ") established the Alameda County — City of <br /> San Leandro (Joint) Redevelopment Project Area (the "Joint Project Area ") and adopted a <br /> redevelopment plan for the Joint Project Area (as thereafter amended, the "Joint Project Area <br /> Redevelopment Plan "); and <br /> WHEREAS, by Ordinance Nos. 1295 N.S., 67 -62, 75 -39, 2000 -009 and 2000 -010, the <br /> City Council and the Agency established the Plaza Project Area (hereafter, the "Plaza Project <br /> Area" and together with the Joint Project Area, collectively, the "Project Areas ") and adopted a <br /> redevelopment plan for the Plaza Project Area (as thereafter amended, the "Plaza Project Area <br /> Redevelopment Plan" and hereafter, together with the John Project Area Redevelopment Plan, <br /> collectively, the "Redevelopment Plans "); and <br /> WHEREAS, the Agency is responsible for carrying out redevelopment of the Project <br /> Areas in accordance with the California Community Redevelopment Law (Health and Safety <br /> Code Sections 33000 et seq.) (the "CRL "), the Redevelopment Plans and the Implementation <br /> Plan adopted for the Redevelopment Plans pursuant to CRL Section 33490 (the <br /> "Implementation Plan "), including the construction and installation of public improvements <br /> consistent with the Redevelopment Plans and the Implementation Plan; and <br /> WHEREAS, the Agency has proposed the expenditure of up to Eleven Million Four <br /> Hundred Fifty Thousand Dollars ($11,450,000) in tax increment funds for the construction of the <br /> Estudillo Callan Parking Garage, Project No. 08- 962 -86 -067 (the "Project ") within the Plaza <br /> Project comprised of the appropriation and expenditure of up to $500,000 in funds from the <br /> available fund balance of the Plaza Project Area, the expenditure of up to $400,000 in funds from <br /> the existing Plaza Project Area appropriation and the expenditure of up to $10,550,000 in funds <br /> from the existing Joint Project Area appropriation; and <br /> WHEREAS, Section 33445.1 of the CRL provides that a redevelopment agency may, <br /> with the consent of the legislative body, pay for all or a portion of the value of land for and the <br /> cost of the installation and construction of public improvements located outside the project area <br /> if the Agency and the legislative body determine that: <br />
