IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 2010 -013 <br /> ORDINANCE REPEALING ARTICLE 1 AND ADDING ARTICLE 1 TO CHAPTER 5 OF <br /> TITLE VII OF THE SAN LEANDRO MUNICIPAL CODE, AMENDING THE STATE - <br /> MANDATED CALIFORNIA BUILDING STANDARDS CODE, AND ADOPTING BY <br /> REFERENCE THE INTERNATIONAL BUILDING CODE. AS AMENDED, <br /> BUILDING CODE <br /> The City Council of the City of San Leandro does ORDAIN as follows: <br /> Section 1. Article 1 of Chapter 5 of Title VII of the San Leandro Municipal Code is <br /> hereby repealed. <br /> Section 2. Article 1 is hereby added to Chapter 5 of Title VII of the San Leandro <br /> Municipal Code to read as follows: <br /> "ARTICLE 1. BUILDING CODE <br /> Section 7 -5 -100: ADOPTION. <br /> Except as hereinafter specifically set forth. the "California Building Standards Code, 2010 <br /> edition" is amended and that certain documents entitled "International Residential Code 2009 <br /> Edition and appendices G and H, "International Building Code, 2009 Edition," with appendix <br /> Chapters G and 1, published by the International Code Council, and Chapters Al, A2, A3, A4 <br /> and A5, of that certain document entitled "International Existing Building Code 2009 edition," as <br /> published by the International Code Council, are hereby adopted by reference as the `Building <br /> Code" of the City of San Leandro. However, in accordance with California Government Code <br /> Section 50022.4, no penalty clauses are adopted by reference. In the event an amendment to the <br /> California Building Standards Code results in differences between these building standards and <br /> the Califomia Building Standards Code, the text of these building standards shall govern. In <br /> accordance with California Health and Safety Code Section 17958.7, express findings that <br /> modifications to the California Building Standards Code are reasonably necessary because of <br /> local climatic, geological or topographical conditions are either already on file with the <br /> California Building Standards Commission. or will be filed prior to the effective date of the <br /> ordinance codified in this Article. In accordance with California Government Code Section <br /> 50022.6, at least one true copy of the International Building Code and the International <br /> Residential Code have been on file with the San Leandro City Clerk since fifteen (15) days prior <br /> to enactment of the ordinance codified in this Article. While this Article is in force, true copies <br /> of the International Building Code and the International Residential Code shall be kept for public <br /> inspection in the office of the San Leandro City Clerk. A reasonable supply of the International <br /> Building Code and the International Residential Code shall be available in the office of the San <br /> Leandro City Clerk for public purchase. <br />
