IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 2010 -018 <br /> ORDINANCE REPEALING ARTICLE 8 AND ADDING ARTICLE 8 <br /> TO CHAPTER 5 OF TITLE VII OF THE SAN LEANDRO MUNICIPAL CODE, AMENDING <br /> THE STATE- MANDATED CALIFORNIA BUILDING STANDARDS CODE, AND <br /> ADOPTING BY REFERENCE THE INTERNATIONAL BUILDING CODE, AS AMENDED, <br /> BUILDING CONSERVATION CODE <br /> The City Council of the City of San Leandro does ORDAIN as follows: <br /> Section 1. Article 8 of Chapter 5 of Title VII of the San Leandro Municipal Code is <br /> hereby repealed. <br /> Section 2. Article 8 is hereby added to Chapter 5 of Title VII of the San Leandro <br /> Municipal Code to read as follows: <br /> "ARTICLE 8. BUILDING CONSERVATION CODE <br /> Section 7 -5 -800: ADOPTION. <br /> Except as hereinafter specifically set forth, the "California Building Standards Code, 2010 <br /> edition" is amended and that certain documents entitled `International Residential Code 2009 <br /> Edition ", `International Building Code, 2009 Edition," with appendix Chapters G and I, <br /> published by the International Code Council. and Chapters Al, A2 , A3, A4 and A5 of that <br /> certain document entitled "International Existing Building Code 2009 edition," as published by <br /> the International Code Council, are hereby adopted by reference as the "Building Code" of the <br /> City of San Leandro. However, in accordance with California Government Code Section <br /> 50022.4, no penalty clauses are adopted by reference. In the event an amendment to the <br /> Califomia Building Standards Code results in differences between these building standards and <br /> the California Building Standards Code, the text of these building standards shall govern. In <br /> accordance with California Health and Safety Code Section 17958.7, express findings that <br /> modifications to the California Building Standards Code are reasonably necessary because of <br /> local climatic, geological or topographical conditions are either already on file with the <br /> California Building Standards Commission, or will be filed prior to the effective date of the <br /> ordinance codified in this Article. In accordance with Califomia Government Code Section <br /> 50022.6, at least one true copy of the International Building Code and the International <br /> Residential Code have been on file with the San Leandro City Clerk since fifteen (15) days prior <br /> to enactment of the ordinance codified in this Article. While this Article is in force, true copies of <br /> the International Building Code, the International Residential shall be kept for public inspection <br /> in the office of the San Leandro City Clerk.
