DATED <br /> • MAY 7, 1987, ANTHONY A. BATARSE, JR., TRUSTEE AND <br /> THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br /> FOR THE DISPOSITION AND DEVELOPMENT OF A PORTION OF THE PROPERTY <br /> LOCATED AT 467 MARINA BOULEVARD (APN # 075 - 0087 - 003 -02), <br /> 505 MARINA BOULEVARD (APN #075 -0087- 004 -04) AND 517 MARINA BOULEVARD (APN <br /> #075- 0087 - 004 -06) AND A PORTION OF THE PROPERTY AT 635 MARINA BOULEVARD <br /> (APN # 075- 0093 - 007 -02) <br /> RECITALS . ' <br /> • <br /> WHEREAS, the Agency has negotiated a Disposition and Development Agreement <br /> ( "Agreement ") between the Agency and the Batarse Family Trust, U.T.A. Dated May 7,, 1987, <br /> Anthony A. Batarse, Jr., Trustee ( "Developer") to develop an automobile dealership at a portion <br /> of the property at 467, 505, 517 and 635 Marina Boulevard (the "Property"), which will further • <br /> the purposes of the Joint Alameda County /City of San Leandro Redevelopment Plan and such <br /> Agreement was approved on October 1, 2001; and <br /> WHEREAS, pursuant to the Agreement, the Agency shall acquire the Property and <br /> convey a portion to the Developer and retain a portion for the development of a road to be <br /> conveyed to the City; and .• <br /> • WHEREAS, the Agency has caused to be prepared a report required by the Health and <br /> Safety Code § 33433 ( "Reuse Report") which contains a summary of the proposed Agreement <br /> to be entered into between the Agency and Developer and a summary of the cost of the <br /> Agreement to the Agency; and <br /> WHEREAS, the Agency desires to amend the Agreement to remove the requirement <br /> • that the Agency retain a portion of the Property for the development of the road; and <br /> WHEREAS, the amendment will result in no increase in the cost of the Agency's <br /> financial obligation as analyzed in the Reuse Report; <br /> NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro hereby • <br /> resolves as follows: <br /> Section 1. The Amendment to the .Disposition and Development Agreement entered <br /> into between the Agency and the Batarse Family Trust, U.T.A.
