• <br /> • <br /> IN THE REDEVELOPMENT AGENCY <br /> OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2002 - 3 (2888) <br /> A RESOLUTION OF THE REDEVELOPMENT AGENCY OF <br /> THE CITY OF SAN LEANDRO AMENDING <br /> THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN <br /> THE BATARSE FAMILY TRUST, U.T.A. DATED MAY 7, 1987, <br /> ANTHONY A. BATARSE, JR., TRUSTEE AND <br /> THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br /> FOR THE DISPOSITION AND DEVELOPMENT OF 505 -517 MARINA BOULEVARD (APN 075- <br /> 0087- 004 -12) (FORMERLY KNOWN AS A PORTION OF THE PROPERTY LOCATED AT 467 <br /> MARINA (APN 075- 0087 - 003 -02), 505 MARINA (APN 75- 0087- 004 -04) AND 517 MARINA <br /> (APN 075- 0087- 004 -06)) AND A PORTION OF THE PROPERTY AT'635 MARINA <br /> BOULEVARD (APN 075- 0093 - 007 -02) <br /> RECITALS <br /> WHEREAS, the Agency has negotiated a Disposition and Development Agreement <br /> ( "Agreement ") between the Agency and the Batarse Family Trust, U.T.A. Dated May 7, 1987, <br /> Anthony A. Batarse, Jr., Trustee ( "Developer ") to develop an automobile dealership at 505 -517 <br /> Marina Boulevard (formerly known as a portion of the property at 467, 505, and 517 Marina) and <br /> 635 Marina Boulevard (the "Property "), which will further the purposes of the Joint Alameda <br /> County /City of San Leandro Redevelopment Plan and such Agreement was approved on <br /> October 1, 2001 and amended on November 13, 2001; and <br /> WHEREAS, the Agency has caused to be prepared a report required by the Health and <br /> Safety Code § 33433 ( "Reuse Report") which contains a summary of the proposed Agreement <br /> to be entered into between the Agency and Developer and a summary of the cost of the <br /> Agreement to the Agency; and <br /> . WHEREAS, the amendment adopted on November 13, 2001, contemplated that a lot <br /> line adjustment between the Developer and the developer of the adjacent property would occur; <br /> and <br /> • <br /> WHEREAS, this amendment will affect the lot line adjustment. <br /> NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro hereby <br /> resolves as follows: <br /> Section 1. The Second Amendment to the Disposition and Development Agreement <br /> entered into between the Agency and the Batarse Family Trust, U.T.A. Dated May 7, 1987, <br /> Anthony A. Batarse, Jr., Trustee is hereby approved. <br /> 1 ' <br />
