IN THE REDEVELOPMENT AGENCY <br /> OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2001 - 2 0 <br /> A RESOLUTION OF THE REDEVELOPMENT AGENCY OF <br /> THE CITY OF SAN LEANDRO AMENDING <br /> THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN LAVERY CALIFORNIA <br /> DEALERSHIP PROPERTIES NO. 1, LLC AND THE REDEVELOPMENT AGENCY OF THE <br /> CITY OF SAN LEANDRO FOR THE DISPOSITION AND DEVELOPMENT OF A PORTION OF <br /> THE PROPERTY LOCATED AT 467 MARINA BOULEVARD (APN # 075- 0087 - 003 -02), <br /> 505 MARINA BOULEVARD (APN #075- 0087 - 004 -04) AND <br /> 517 MARINA BOULEVARD (APN #075- 0087- 004 -06) <br /> RECITALS <br /> WHEREAS, the Agency has negotiated a Disposition and Development Agreement <br /> ( "Agreement ") between the Agency and Lavery California Dealership Properties No. 1, LLC <br /> ( "Developer") to develop an automobile dealership at a portion of the property at 467, 505 and <br /> 517 Marina Boulevard, which will further the purposes of the Joint Alameda County /City of San <br /> Leandro Redevelopment Plan and such Agreement was approved on October 1, 2001; and <br /> WHEREAS, pursuant to the Agreement, the Agency shall acquire the Property and <br /> convey a portion to the Developer and retain a portion for the development of a road to be <br /> conveyed to the City; and <br /> WHEREAS, the Agency has caused to be prepared a report required by the Health and <br /> Safety Code § 33433 ( "Reuse Report") which contains a summary of the proposed Agreement <br /> to be entered into between the Agency and Developer and a summary of the cost of the <br /> Agreement to the Agency; and <br /> WHEREAS, the Agency desires to amend the Agreement to remove the requirement <br /> that the Agency retain a portion of the Property for the development of the road; and <br /> WHEREAS, the amendment will result in no increase in the cost of the Agency's <br /> financial obligation as analyzed in the Reuse Report; <br /> NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro hereby <br /> resolves as follows: <br /> Section 1. The Amendment to the Disposition and Development Agreement between <br /> the Agency and Lavery California Dealership Properties No. 1, LLC to develop an automobile <br /> dealership at a portion of the property at 467, 505 and 517 Marina Boulevard is hereby <br /> . approved. <br /> Introduced by Agency Member <br /> and passed and adopted this day of 2001, <br /> by the following called vote: <br /> 1 <br />
