IN THE REDEVELOPMENT AGENCY <br /> OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2002 - 4 (2888) <br /> A RESOLUTION OF THE REDEVELOPMENT AGENCY OF <br /> THE CITY OF SAN LEANDRO AMENDING <br /> THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN LAVERY CALIFORNIA <br /> DEALERSHIP PROPERTIES NO. 1, LLC AND THE REDEVELOPMENT AGENCY OF THE <br /> CITY OF SAN LEANDRO FOR THE DISPOSITION AND DEVELOPMENT OF 467 MARINA <br /> BOULEVARD (APN 075 - 0087 - 004 -11) (FORMERLY KNOWN AS A PORTION OF THE <br /> PROPERTY LOCATED AT 467 MARINA (APN 075- 0087 - 003 -02), 505 MARINA (APN 075- <br /> 0087- 004 -04) AND 517 MARINA (APN 075 - 0087 - 004 -06)) <br /> RECITALS <br /> WHEREAS, the Agency has negotiated a Disposition and Development Agreement <br /> ( "Agreement ") between the Agency and Lavery California Dealership Properties No. 1, LLC <br /> ( "Developer") to develop an automobile dealership at 467 Marina Boulevard (formerly known as <br /> a portion of the property at 467, .505 and 517 Marina Boulevard), which will further the purposes <br /> of the Joint Alameda County/City of San Leandro Redevelopment Plan and such Agreement <br /> was approved on October 1, 2001 and amended on November 13, 2001; and <br /> WHEREAS, the Agency has caused to be prepared a report required by the Health and <br /> Safety Code § 33433 ( "Reuse Report") which contains a summary of the proposed Agreement <br /> to be entered into between the Agency and Developer and a summary of the cost of the <br /> Agreement to the Agency; and <br /> WHEREAS, the amendment adopted on November 13, 2001, contemplated that a lot <br /> line adjustment between the Developer and the developer of the adjacent property would occur; <br /> and <br /> • <br /> WHEREAS, this amendment will affect the lot line adjustment. <br /> NOW, THEREFORE, the Redevelopment Agency of the City of San Leandro•hereby <br /> resolves as follows: <br /> Section 1. The Second Amendment to the Disposition and Development Agreement <br /> between the Agency and Lavery California Dealership Properties No. 1, LLC to develop an <br /> automobile dealership at 467 Marina Boulevard (formerly known as a portion of the property at <br /> 467, 505 and 517 Marina Boulevard) is hereby approved. <br /> • <br /> 1 <br />
