IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> ORDINANCE NO. 2011-003 <br /> AN ORDINANCE AMENDING PROVISIONS OF THE SAN LEANDRO <br /> ZONING CODE RELATING TO USES ALLOWED, PARKING <br /> REQUIREMENTS, AND STATUS OF PLANNED DEVELOPMENTS IN THE <br /> DOWNTOWN <br /> WHEREAS, in 2002, the City of San Leandro adopted a new General Plan, which <br /> includes short -term and long -term goals and policies concerning the development of <br /> Downtown San Leandro, and which takes into consideration existing plans and studies <br /> including the Downtown Plan and Urban Design Guidelines, adopted in February of <br /> 2001, as well as standards and polices applicable to the Plaza Redevelopment Area, <br /> adopted by the City's Redevelopment Agency; and, <br /> WHEREAS, the City adopted a Transit Oriented Development Strategy and <br /> Zoning Code amendments that created the Downtown Area (DA) Zones in 2007; and, <br /> WHEREAS, the City, after consultation with the Downtown Association and the <br /> San Leandro Chamber of Commerce, and various private business owners, has <br /> determined that updated amendments to the Zoning Code are required to allow greater <br /> flexibility for uses seeking to establish in the Downtown Area; and, <br /> WHEREAS, the City has prepared an Initial Study and Negative Declaration for <br /> the Zoning Code Amendments, pursuant to the California Environmental Quality Act <br /> ( "CEQA "). <br /> THEREFORE, the City Council of the City of San Leandro ordains as follows: <br /> SECTION 1. Sections 1 -304, 2 -636, 2 -640, 2 -642, 2 -644 of Article 6; Section 3 -1022 of <br /> Article 10; and Section 4 -1702 of Article 17 of the City of San Leandro Zoning Code are <br /> hereby amended as set forth in Exhibit A, which is attached and incorporated by <br /> reference into this Ordinance. <br /> SECTION 2. Severability. <br /> If any section, subsection, subdivision, paragraph, sentence, clause or phrase of <br /> the Ordinance is for any reason held to be unconstitutional, invalid, or ineffective by any <br /> court of competent jurisdiction, such decision shall not affect the validity or effectiveness <br /> of the remaining portions of this Ordinance or any part hereof. The City Council hereby <br /> declares that it would have passed each section, subsection, subdivision, paragraph, <br /> sentence, clause and phrase of the Ordinance irrespective of the fact that one or more of <br /> them would be declared unconstitutional or invalid. To this end, the provisions of the <br /> Ordinance are declared to be severable. <br />
