• <br /> Cell Site No.: CN4611 <br /> Cell Site Name: Aurora & Fairway <br /> Fixed Asset No.: 10101868 <br /> Market: San Francisco <br /> Address: 13800 Monarch Bay Dr., San Leandro, CA <br /> FIRST AMENDMENT TO COMMUNICATIONS SITE LEASE AGREEMENT <br /> This FIRST AMENDMENT TO COMMUNICATIONS SITE LEASE AGREEMENT <br /> ( "Amendment "), dated as of the latter of the signature dates below (the "Effective Date "), is by <br /> and between the City of San Leandro, a municipal corporation ( "Lessor ") and New Cingular <br /> Wireless PCS, LLC, a Delaware limited liability company ( "Lessee "). <br /> WHEREAS, Lessor and Lessee entered into a certain Communications Site Lease <br /> Agreement dated May 16, 2005, whereby Lessor leases to Lessee certain Premises therein <br /> described, that are a portion of the real property located at 13800 Monarch Bay Drive, San <br /> Leandro, CA (the "Lease "); and <br /> WHREAS, the parties desire to memorialize the first Renewal Term of the Lease which <br /> will expire on August 31, 2010; and <br /> WHEREAS, Lessor and Lessee desire to adjust the rent in conjunction with the renewal <br /> of the Lease contained herein; and <br /> WHEREAS, Lessor and Lessee desire to add relocation language to the Lease; and <br /> WHEREAS, Lessor and Lessee desire to amend the Lease to modify the notice section <br /> thereof; and <br /> WHEREAS, Lessor and Lessee, in their mutual interest, wish to amend the Lease as set <br /> forth below accordingly. <br /> 1. Incorporation of Recitals. The recitals set forth above are incorporated herein as if set forth <br /> in their entirety. <br /> 2. Term. The parties agree under Section 4 of the Lease, the Lease will renew for one (1) five <br /> (5) year term with two (2) additional three (3) year Extension Terms renewable upon the same <br /> terms and conditions unless either party notifies the other party in writing of its intention not to <br /> renew the Lease at least twelve months (12) months prior to the expiration of the existing <br /> Renewal Term. <br /> 3. Rent. Beginning September 1, 2010, Rent shall be increased to Two Thousand Two Hundred <br /> Fifty and 00 /100 ($2,250.00) per month, subject to 3% annual increases as provided in Section 5 <br /> of the Lease. <br />
