The primary goal of the ordinance is to <br />eliminate single -use takeout containers that are not compostable or recyclable in an effort to <br />further the City's waste diversion goals. <br />Staff recommends that the City Council approve an ordinance amending Chapter 3 -8 of the San <br />Leandro Municipal Code to prohibit the use of polystyrene foam food service ware, effective <br />November 1, 2012. <br />BACKGROUND <br />In October of 2010, the City of Hayward adopted an ordinance to prohibit the use of polystyrene <br />foam food service ware products by food establishments. Shortly thereafter, members of the City <br />Council Rules and Communications Committee asked staff to develop a similar ordinance for <br />San Leandro. Other cities in Alameda County with bans on polystyrene foam food service ware <br />include Albany, Alameda, Berkeley, Emeryville, Fremont, Livermore, and Oakland. <br />In developing the ordinance, staff evaluated the Alameda County ordinances, in addition to <br />ordinances for the City of Millbrae and the City of Richmond. Staff based the proposed <br />ordinance on the City of Hayward ordinance language, but changed it slightly because the City <br />of San Leandro does not allow biodegradable plastic food service ware (marked #7) in the <br />
