CONTRACT DESIGNATING THE CITY OF SAN LEANDRO <br /> AS A SUBRECIPIENT OF HOME FUNDS <br /> This AGREEMENT is made and entered into this 2_Ca' day of 11, by and <br /> between the CITY OF SAN LEANDRO, hereinafter called "City," and the C UNTY OF <br /> ALAMEDA, hereafter called "County." <br /> WITNESSETH: <br /> WHEREAS the City and County have entered into a Cooperative Agreement to form the <br /> Alameda County HOME Consortium to qualify for HOME Investment Partnership Act funds, <br /> funded by the U.S. Department of Housing and Urban Development; and <br /> WHEREAS the County is the lead agency in the Consortium, designated by HUD as the HOME <br /> Participating Jurisdiction; and <br /> WHEREAS the City and the County have determined that it is mutually beneficial to have <br /> County disburse HOME funds for HOME- eligible activities in City; and <br /> WHEREAS the City must be designated a HOME Sub - recipient in order to directly execute <br /> contracts for HOME- funded activities; <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: rob <br /> A. STATEMENT OF WORK ^ <br /> CITY will perform or arrange for the performance of the work under this Agreement in b <br /> the manner and time provided herein and in accordance with: the budget; the scope of <br /> work and any specifications and drawings; and all related documents and provisions <br /> attached he fotk as Exhibit A and incorporated herein by reference. � <br /> B. COMMENCEMENT AND COMPLETION REQUIREMENTS 1 <br /> 1. Upon execution of this Agreement, City shall be designated as a HOME Sub - recipient for <br /> 2011 fiscal year funds for the purpose of administering HOME - eligible activities in the <br /> City, the funds for which shall be disbursed by the County. The maximum amount of <br /> fiscal year 2011 HOME funds covered by this agreement shall be $289,894. In the event <br /> that the HOME allocation to the Consortium is reduced by HUD, or the City does not meet <br /> any deadline for commitment or expenditure of funds as established by the County, the <br /> City's allocation will be reduced proportionately. <br /> 2. As a sub - recipient, City may contract with other entities to perform HOME - eligible <br /> activities. HOME eligible activities City desires to engage in must be approved by County <br /> in advance of any contract being executed. County approval will be evidenced by a project <br /> approval letter to the City. <br /> 3. City agrees that any HOME- eligible activities funded through this Agreement shall be <br />
