• <br /> • <br /> • IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 96-62 (1120) <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> LEANDRO APPROVING THE REUSE REPORT REQUIRED BY <br /> HEALTH & SAFETY CODE § 33433 FOR THE AUTOMALL PROJECT <br /> OF THE COUNTY OF ALAMEDA - CITY OF SAN LEANDRO JOINT <br /> REDEVELOPMENT PROJECT AND THE FORM OF THE DISPOSITION <br /> AND DEVELOPMENT AGREEMENT BETWEEN THE BATARSE <br /> FAMILY TRUST AND THE AGENCY. <br /> Recitals <br /> WHEREAS, the Redevelopment Agency of the City of San Leandro ( "Agency ") has <br /> negotiated in good faith a form of the Disposition and Development Agreement <br /> ( "Agreement ") between the Agency and the Batarse Family Trust ( "Batarse ") where the <br /> Agency may acquire real property parcels in the County of Alameda - City of San Leandro <br /> Joint Redevelopment Project Area ("Joint Project Area ") and convey those parcels to <br /> Batarse, who shall then build and operate an automall on Marina Boulevard, east of <br /> Interstate 880 ( "Automall "); <br /> WHEREAS, the Agreement places additional restrictions, covenants and conditions <br /> on Batarse regarding the building and operating of several automobile dealerships forming <br /> the Automall; <br /> WHEREAS, the Agreement provides that the Agency may acquire parcels in the <br /> Joint Project Area, which acquisition may be in whole or in part, directly or indirectly <br /> financed with tax increment money, and such acquired parcels may then be conveyed to <br /> Batarse for an amount of consideration set forth in the Agreement; <br /> WHEREAS, Agency has caused to be prepared a report required by Health and <br /> Safety Code § 33433 ( "Reuse Report ") which contains a summary of the form of the <br /> Disposition and Development Agreement ( "Agreement ") to be entered into between the <br /> Agency and Batarse and a summary of the cost of the Agreement to the Agency, and the <br /> Agency has made the Reuse Report available for public inspection pursuant to Health and <br /> Safety Code § 33433; <br /> WHEREAS, the summary of the cost of the Agreement includes: land acquisition <br /> costs, clearance costs, remediation costs, administrative costs; the estimated value of the <br /> interest to be conveyed determined at the highest and best uses permitted under the Joint <br /> Project Redevelopment Plan; the estimated value of the interest to be conveyed determined <br /> at use with conditions, covenants, and development costs required by the sale; and an <br /> explanation of why the sale of the property will assist in the elimination of blight; <br /> 1 <br />
