AMENDMENT NO. 1 TO AGREEMENT <br /> BETWEENTHE CITY OF SAN LEANDRO <br /> AND NEIGHBORHOOD SOLUTIONS <br /> FOR HOUSING REHABILITATION <br /> THIS AMENDMENT TO AGREEMENT is made at San Leandro, California, as of January 1, <br /> 2013, by and between the CITY OF SAN LEANDRO, (the "City"), and NEIGHBORHOOD <br /> SOLUTIONS ("Consultant")to extend the term of the contract. <br /> This Amendment is made in contemplation of the following facts, understandings and <br /> intentions of the parties: <br /> A. On July 1, 2012, the City and the Consultant entered into a Community Development <br /> Block Grant Consulting Services Agreement ("Agreement") to provide housing rehabilitation services <br /> to eligible residential property owners in San Leandro. <br /> B. As of January 1, 2013, the City has a growing list of rehabilitation grant applicants <br /> and requires additional services from Consultant for those persons. <br /> C. The City has identified an additional $55,000.00 in general fund revenue to provide <br /> for the additional rehabilitation grants and Consultant services. <br /> D. The parties wish to amend the Agreement to reflect the addition of the applicants and <br /> the additional funding for Consultant services. <br /> NOW, THEREFORE, the parties agree as follows: <br /> 1. Amend Section 2.1 Use of CDBG Funds to read: <br /> "2.1 Use of CDBG and General Funds. Consultant hereby agrees to use the CDBG <br /> and General funds provided to Consultant solely for the services pursuant to all of <br /> the terms and conditions of this Agreement. The services are more particularly set <br /> forth in the "Scope of Services" attached hereto as Exhibit "A" and incorporated <br /> herein by reference. The CDBG and General funds shall be used solely to reimburse <br /> the actual expenses incurred by Consultant for the services as set forth in the <br /> "Budget" attached hereto as Exhibit "B" and incorporated herein by reference. <br /> Contract Officer may approve minor changes to the budget that do not exceed the <br /> maximum amounts in Section 3.1 and 3.2 of this Agreement." <br /> 2. Amend Section 3.2 Maximum Amount of General Funds to read: <br /> "City hereby agrees to pay Consultant a sum not to exceed FIFTY-FIVE THOUSAND <br /> AND NO/100 DOLLARS ($55,000.00) in general funds, notwithstanding any contrary <br /> indications that may be contained in Consultant's proposal, for services to be <br /> performed and reimbursable costs incurred under this Agreement." <br /> 3. In all other aspects the Agreement is hereby ratified, confirmed and shall continue in <br /> full force and effect. <br />
