( 20121893a0 06/11/2012 11:43 AM <br /> 0- OFFICIAL RECORDS OF ALAMEDA COUNTY <br /> PATRICK O'CONNELL <br /> RECORDING REQUESTED BY: ��,FOwN` RECORDING FEE: 0.00 <br /> City of San Leandro <br /> Exempt from Fees Pursuant to <br /> Government Code §§6103 and 27383 III I 01 II II 01 I 18 PGS <br /> WHEN RECORDED MAIL TO: <br /> City Attorney (/ <br /> City of San Leandro (X� <br /> 835 East 14th Street <br /> San Leandro,CA 94577-3767 <br /> (THIS SPACE FOR RECORDER'S USE ONLY) <br /> NOTICE OF EXEMPTION <br /> FROM THE CITY OF SAN LEANDRO <br /> REAL PROPERTY TRANSFER TAX <br /> NOTICE IS HEREBY GIVEN that I,DAVID BAUM,as the Finance Director for the City of <br /> San Leandro, County of Alameda, State of California, on the 21st day of May 2012, do formally <br /> execute the following action on behalf of the City of San Leandro: <br /> GRANT an exemption from Section 2-3-105(a) of the San Leandro Municipal Code, <br /> otherwise known herein as the City of San Leandro Real Property Transfer Tax,in accordance with <br /> Section 2-3-155 of the San Leandro Municipal Code and under the authority granted to me by the <br /> City of San Leandro pursuant to Section 2-3-160 of the San Leandro Municipal Code; <br /> NOTE that said exemption applies only to certain parcels in the City of San Leandro,County <br /> of Alameda, State of California,identified as Assessor's Parcel Number 412-0006-007-00,the exact <br /> specifications of which are described with particularity pursuant to the Legal Description of the <br /> Property, attached hereto as Exhibit A and incorporated herein by reference; <br /> NOTE that said exemption was granted to Eden Housing in furtherance of the Joint Escrow <br /> Instructions, which are attached hereto as Exhibit B and incorporated herein by reference; and <br /> NOTE that said exemption shall apply for the effective duration of the Joint Escrow <br /> Instructions so long as Eden Housing and the City of San Leandro remain parties thereto,unless said <br /> exemption is preempted by local, state or federal law or the City of San Leandro, in its sole and <br /> exclusive discretion and where permitted by law, directs the Finance Director to rescind said <br /> exemption by recording a document with the County of Alameda Clerk-Recorder's Office to that <br /> effect,following a consultation between the Finance Director,the Community Development Director <br /> and the City Attorney,with thirty(30)days'notice given to Eden Housing prior to said recordation. <br /> (Signatures on Following Page) <br /> 1888350.1 Page 1 of[total#of pages in notice+exhibits] <br />
