IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2015-005 <br /> RESOLUTION APPROVING A FIBER LICENSE AGREEMENT WITH <br /> SAN LEANDRO UNIFIED SCHOOL DISTRICT(SLUSD) FOR EXCLUSIVE ACCESS TO <br /> AND USE OF CITY-OWNED FIBER OPTIC STRANDS <br /> WHEREAS,the City of San Leandro owns fiber strands within the fiber optic cable facility <br /> commonly known as the San Leandro Dark Fiber Loop (the "Fiber System"),as evidenced by a <br /> current agreement between the City and San Leandro Dark Fiber, LLC (the"License Agreement"); <br /> and <br /> WHEREAS,the SLUSD wishes to access and use specific City-owned fiber optic strands <br /> along various portions of the Fiber System subject to the terms and conditions set forth in this <br /> Agreement; and <br /> WHEREAS,this request fulfills various elements of the Economic Development Plan and <br /> General Plan previously adopted by the City Council, in addition to adopted City Council Goals; <br /> and <br /> WHEREAS, adoption of this agreement would result in numerous community benefits <br /> resulting from the ability of students and teachers to access a 10 GBPS internet speed connection, <br /> the fastest commercial connection available anywhere in the United States; and <br /> WHEREAS, an agreement between the City of San Leandro and San Leandro Unified <br /> School District, a copy of which is attached, has been presented to the City Council; and <br /> WHEREAS,the City Council is familiar with the contents thereof; and <br /> WHEREAS,the City Manager recommends approval of said agreement. <br /> NOW, THEREFORE,the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That said agreement is hereby approved and execution by the City Manager is hereby <br /> authorized. <br /> ***** <br />
