IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2016-005 <br /> RESOLUTION CONSENTING TO THE PROPOSED LOCATION OF <br /> 1-ILLUMINATED MARQUEE OUTDOOR ADVERTISING SIGN ("MARQUEE SIGN")AT <br /> THE BURRELL SPORTS FIELD <br /> (RELATED TO CALTRANS ODA PERMIT APPLICATION NOS. A04-0566 &A04-0567) <br /> WHEREAS, in 2014 the City of San Leandro (City) and the San Leandro Unified School <br /> District("SLUSD" or the "District") executed a joint use agreement for Burrell Sports Field and <br /> the Pacific Sports Complex; and <br /> WHEREAS,the City and the District would like to see a marquee sign erected upon <br /> District property adjacent to the Burrell Sports Field; and <br /> WHEREAS, in coordination with the SLUSD, American Outdoor Advertising submitted <br /> Outdoor Advertising Act permits to the California Department of Transportation(Ca1TRANS) <br /> for the construction of 1-Marquee sign at the Burrell Sports Field; and <br /> WHEREAS, on October 15, 2015, the District received approval from the California <br /> Department of General Services, Division of the State Architect for its plans and specifications <br /> to construct 1-Marquee Sign for the Burrell Sports Field; and <br /> WHEREAS, California Education Code section 17280 provides that the Department of <br /> General Services, by and through the Division of the State Architect(DSA), has exclusive <br /> jurisdiction over all aspects of public school construction to ensure that plans, specifications and <br /> construction comply with the building codes applicable to school buildings. The Burrell Sports <br /> Field is used for public school programs, and thus qualifies as a public school facility subject to <br /> the jurisdiction of the DSA; and <br /> WHEREAS, California Business & Professions Code section 5354(a)provides that the <br /> city with land use jurisdiction over the property upon which the location for the Ca1TRANS <br /> ODA permits is situated must consent to the placement of the marquee sign. <br /> WHEREAS,the City Manager recommended approval of this resolution, which if <br /> approved rescinds Resolution No. 2015-195. <br /> NOW, THEREFORE,the City Council of the City of San Leandro does RESOLVE, as <br /> follows: <br /> 1. That by the City Council's approval of this resolution, Resolution No. 2015-195 is <br /> rescinded; and <br /> 2. That the consent required by California Business & Professions Code section <br /> 5354(a) for the location of ODA permit application Nos. A04-0566 & A04-0567, construction of <br />
