A 1994 <br />DEED OF TRUST AND ASSIGNMENT OF RENTS <br />A. THIS DEED OF TRUST, made this 18th day of July, 1994, <br />between DEAF COUNSELING, ADVOCACY AND REFERRAL AGENCY (DCARA), a <br />California nonprofit corporation, herein called Trustor, whose <br />address is 22289 Pearch Street, Hayward, CA 94541-3915; and the <br />City of San Leandro, a municipal corporation, herein called <br />Trustee; and the City of San Leandro, a municipal corporation, <br />herein called Beneficiary. Trustor, in consideration of the <br />indebtedness herein recited, and the trust herein created, hereby <br />irrevocably grants, transfers and assigns to the Trustee in <br />trust, with the power of sale and the right of entry in <br />possession, all of Trustor's rights, title and interests now held <br />or hereafter acquired in and to the property described in Exhibit <br />A as attached and herein incorporated by reference. <br />B. For the purposes of this Deed of Trust, the following <br />terms shall have meanings as set forth below: <br />,(1) Low- to moderate -income household. A low- to <br />moderate -income household is defined as a household whose <br />combined annual income from all members does not exceed <br />eighty percent (80%) of the median annual income, adjusted <br />by household size, for the Oakland metropolitan area as <br />defined in the U.S. Department of Housing and Urban <br />Development (HUD) or successor agency. Should HUD or its <br />successor, if any, fail to publish such income information, <br />the City of San Leandro may use or develop other such <br />reasonable methods to determine the income figures that will <br />be used to determine the level of income which shall <br />classify as a low- to moderate -income household. <br />(2) Sale. The term sale means any transfer of title to <br />or lease with option to purchase the property and <br />additionally includes an execution of an installment sale <br />contract giving the purchaser a right to possess the <br />1 <br />
