City of San Leandro <br />Meeting Date: October 7, 2019 <br />Staff Report <br />Agenda Section:File Number:19-502 CONSENT CALENDAR <br />Agenda Number:8.I. <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Debbie Pollart <br />Public Works Director <br />FINANCE REVIEW:Not Applicable <br />TITLE:Staff Report for a First Reading of a City of San Leandro City Council Ordinance <br />to Amend Title 5, Chapter 5-2, Sections 5-2-100, 5-2-200, 5-2-210, 5-2-215, <br />5-2-225, and 5-2-230 of the San Leandro Municipal Code Relating to Street <br />Trees <br />SUMMARY AND RECOMMENDATIONS <br />Staff recommends that the City Council hold a first reading for Municipal Code amendments <br />pertaining to City street tree regulations. <br />BACKGROUND <br />At the September 3, 2019 City Council meeting, the City Council adopted a resolution to amend <br />the City of San Leandro Administrative Code pertaining to City street trees and directed staff to <br />modify proposed amendments to the San Leandro Municipal Code. The City Council’s proposed <br />amendments were substantive and warranted bringing this item back to the City Council for a new <br />first reading. <br />Analysis <br />The amendments to the San Leandro Municipal Code (specifically Section 5-2-200 of Chapter <br />5-2) proposed by staff at the September 3, 2019 City Council meeting included raising the fine for <br />illegal trimming and/or removal of City street trees from $100 per incident to $500. Per direction <br />from the City Council at its September 3, 2019 meeting, staff modified Section 5-2-200 to <br />indicate that the fine would be ‘up to $1,000’. This language allows staff enforcement discretion <br />on the severity of the infraction, and provides a sliding scale for the amount of the fine to be <br />imposed. <br />All other proposed amendments to Chapter 5-2 remain unchanged from what was presented at <br />the September 3, 2019 City Council meeting. <br />Page 1 City of San Leandro Printed on 10/2/2019 <br />165
