TO:City Council FROM:Jeff Kay City Manager BY:Debbie Pollart Public Works Director FINANCE REVIEW:Not Applicable TITLE:Staff Report for a First Reading of a City of San Leandro City Council Ordinance to Amend Title 5, Chapter 5-2, Sections 5-2-100, 5-2-200, 5-2-210, 5-2-215, 5-2-225, and 5-2-230 of the San Leandro Municipal Code Relating to Street Trees SUMMARY AND RECOMMENDATIONS Staff recommends that the City Council hold a first reading for Municipal Code amendments pertaining to City street tree regulations. BACKGROUND At the September 3, 2019 City Council meeting, the City Council adopted a resolution to amend the City of San Leandro Administrative Code pertaining to City street trees and directed staff to modify proposed amendments to the San Leandro Municipal Code. The City Council’s proposed amendments were substantive and warranted bringing this item back to the City Council for a new first reading. Analysis The amendments to the San Leandro Municipal Code (specifically Section 5-2-200 of Chapter 5-2) proposed by staff at the September 3, 2019 City Council meeting included raising the fine for illegal trimming and/or removal of City street trees from $100 per incident to $500. Per direction from the City Council at its September 3, 2019 meeting, staff modified Section 5-2-200 to indicate that the fine would be ‘up to $1,000’. This language allows staff enforcement discretion on the severity of the infraction, and provides a sliding scale for the amount of the fine to be imposed. All other proposed amendments to Chapter 5-2 remain unchanged from what was presented at the September 3, 2019 City Council meeting. Page 1 City of San Leandro Printed on 10/2/2019 165
