The land use restrictive covenant placed on the Property shall run with the Property and <br />thus impose restrictions on all future owners and tenants unless a Notice of Release is executed <br />and recorded by the City of San Leandro ("City"). <br />CONDITIONS OF USE OF STRUCTURES <br />NOW THEREFORE, in consideration of the mutual benefits, promises and agreements set out <br />herein, the parties agree as follows: <br />1. The parties hereto agree that execution of this Declaration by Owner and City entitles the <br />owner to add two new bedrooms, two new bathrooms, a family room and work studio at <br />the rear of the existing single-family residence. The addition totals 960 square feet as <br />approved by Permit Number B19-1899. <br />2. Permitted Use. Owner agrees that the addition shall be used as a family room, bedrooms, <br />two full bathrooms, and work studio located in the rear of the existing single-family <br />residence and shall not be used as a separate residential unit. <br />3. Maximum 4 Bedrooms. Owner agrees that the existing residence and the addition <br />together shall not exceed a total of four bedrooms; unless and until it and the property <br />meet all zoning requirements for a single-family home including but not limited to <br />parking and setbacks, per the applicable Zoning Code §4-1704. <br />4. One Residential Unit. Owners agree that the existing residence and the addition shall not <br />be used as more than one residential unit with one kitchen at any time; unless and until it <br />and the property meet all residential, zoning, and building requirements and permits for <br />accessory dwelling units including but not limited to density (units/acre), parking, <br />setbacks, access and all applicable Building Code provisions. <br />5. Compliance.
