IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 96 - 76 (2789 ) <br />RESOLUTION ACCEPTING THE WORK FOR <br />WEST JUANA AVENUE RECONSTRUCTION, EAST 14TH STREET <br />TO SAN LEANDRO BOULEVARD <br />PROJECT NO. 94-210-8302 <br />Recitals <br />Pursuant to a contract between the City and Gallagher & Burk, Inc., (Contractor) dated <br />August 7, 1995, West Juana Reconstruction, East 14th Street to San Leandro Boulevard, Project <br />No. 94-210-8302, has been completed. <br />Said work has been completed in accordance with the plans and specifications therefor <br />and to the satisfaction of the Engineering and Transportation Director, and he therefore <br />recommends that said work be accepted. <br />follows: <br />Contractor has refused to sign the Final Agreement of Quantities. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />1. That the work hereinbefore described is hereby conditionally accepted subject to <br />the City Engineer first receiving Final Agreement of Quantities in compliance with <br />the plans and specifications for the contract, acceptable to the City Attorney, from <br />Gallagher and Burk, Inc. <br />2. That the City Clerk be and is hereby directed to file a Notice of Completion on <br />said project. <br />3. That the bonds given for performance and payment of said conditions shall <br />remain in full force and affect until completion of six month guarantee period or <br />earlier if authorized by the City Engineer. <br />
