City of San Leandro <br />Meeting Date: September 19, 2022 <br />Ordinance <br />Agenda Section:File Number:22-549 CONSENT CALENDAR <br />Agenda Number:10.b. <br />TO:City Council <br />FROM:Fran Robustelli <br />City Manager <br />BY:Andrew Mogensen <br />Planning Manager <br />TITLE:Second Reading to Adopt Ordinance 2022-013 Amending Sections 5.08.136 <br />and 5.12.132 of the San Leandro Zoning Code to Extend by Two Years the <br />Entitlements for Qualified Housing Projects <br />SUMMARY AND RECOMMENDATION <br />On September 6, 2022, the City Council introduced Ordinance 2022-013 amending sections <br />5.08.136 and 5.12.132 of the San Leandro Zoning Code to extend by two years the entitlements <br />for qualified housing projects. <br />ENVIRONMENTAL REVIEW <br />The proposed amendments are exempt from the California Environmental Quality Act (“CEQA”) <br />based on the rule set forth in CEQA Guidelines section 15061(b)(3) that CEQA applies only to <br />projects that have the potential for causing a significant effect on the environment. As an <br />extension of zoning permits for previously approved projects, each of which has already <br />individually been subject to any applicable environmental review, it can be seen with certainty that <br />there is no possibility that the Ordinance will have a significant effect on the environment. <br />BOARD/COMMISSION RECOMMENDATION <br />At its public hearing held on July 7, 2022, the Planning Commission adopted Resolution No. <br />2022-006 by a 5-0 decision, with Commissioners Tejada and Santos absent, recommending the <br />City Council amend the Zoning Code to automatically extend residential project entitlements <br />issued after January 1, 2019 for two (2) years.
