Miguel, City Clerk <br />City of San Leandro <br />835 East 14th Street <br />San Leandro, California 94577 THIS SPACE FOR RECORDER'&V,%I 0LX V <br />(No fee pursuant to Government Code Section 27383) <br />14 PGS <br />NDRO <br />AGREEMENT TO CONDITIONS OCT 10 2022 <br />PLN21-0026 CITY CLERK'S OFFICE <br />1815 Williams Street (APN 77A-735-1-2) <br />Hiroyasu Iwaya, True World Foods San Francisco, LLC (Applicant & Property Owner) <br />THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br />corporation, hereinafter referred to as "City," and Hiroyasu Iwaya, True World Foods San Francisco, <br />LLC, hereinafter referred to as "Applicant" and "Property Owner". <br />Applicant applied for and received approval for a Site Plan Review Permit to allow for the <br />construction of a two-story 50,395 square feet industrial building and associated circulation and site <br />improvements on the subject project zoned Industrial General (IG) located at 1815 Williams Street; <br />Alameda County Accessor's Parcel Number (APN): 77A-735-1-2. The project also proposes to sub- <br />divide an existing parcel into two separate parcels with the existing industrial building to be at the <br />northern parcel and the new construction building to be at the southern parcel. <br />NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is mutually agreed <br />as follows: <br />1. Applicant and Property Owner agrees to comply with the Conditions of Approval, more <br />specifically described in the list of Conditions of Approval, attached hereto, and as described <br />in the exhibits on file in the Community Development Department, all of which are <br />incorporated herein by this reference. <br />2. This agreement shall be binding upon and inure to the benefit of the parties hereto and their <br />respective heirs, successors, and assigns. <br />3. City is authorized to record this agreement and any amendments thereto with the Alameda <br />County Recorder, California. All amendments hereto must be in writing and signed by the <br />appropriate authorities of the City and Applicant and Property Owner. The Applicant and/or <br />Property Owner will be charged the costs of recordation and agrees to pay same.
