<br />VI. FIRE DEPARTMENT REQUIREMENTS <br /> <br />A. The day care center shall comply with all building and fire code requirements, <br />including any requirements for exits, fire sprinkler or fire alarm system(s). Plans <br />shall be submitted to building and fire department for review prior to the start of <br />any work. <br /> <br />B. The operator shall have fire code inspections prior to the issuance of a business <br />license for the day care use. <br /> <br />VII. MAINTENANCE <br /> <br />A. The site shall be well-maintained and shall be kept free oflitter, debris and weeds. <br /> <br />B. Any graffiti on the portion of the property occupied by the applicant shall be <br />removed. <br /> <br />C. All landscaping in the play area shall be maintained in a healthy, growing condition <br />at all times. <br /> <br />D. All signage shall be kept in a good, clean, sound condition at all times; any damages <br />shall be promptly repaired. <br /> <br />VIII. GENERAL CONDITIONS <br /> <br />A. All requirements of the State of California for child care facilities shall be satisfied <br />and maintained current and in compliance at all times. <br /> <br />B. The approvals granted by the City as a result of this application, as well as the <br />Conditions of Approval, shall be recorded in the office of the County Recorder of <br />Alameda County. <br /> <br />C. No application for amendment of the application or Conditions of Approval may be <br />accepted or submitted for processing by the City unless (i) there is full compliance <br />with all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director waives compliance with minor terms of the application and <br />Conditions of Approval pending application for amendment. <br /> <br />D. Pursuant to Zoning Code Section 5-2218, this approval shall lapse on January 5, <br />2007, unless a) a building permit has been issued, coupled with diligent progress <br />evidencing a good faith intent to commence the intended use, or b) a written request <br />for a one-year extension of the use permit is approved by the Community <br />Development Director. <br /> <br />Conditions of Approval <br />PLN2005-00122 <br /> <br />January 5, 2006 <br />Page 6 of6 <br />
