<br />MINUTES Page II <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-September 19, 2005 <br /> <br />Kathleen Warner, San Leandro resident, addressed the City Council, expressing <br />agreement with the previous speaker's comments. <br /> <br />Adam Warner, San Leandro resident, addressed the City Council, reading from the poem, <br />"Sara Cynthia Sylvia Stout Would Not Take the Garbage Out" to illustrate one of the <br />problems with the neighbor at 411 Lewis. <br /> <br />Gene Privette, San Leandro resident, addressed the City Council, expressing agreement <br />with the statements made by Scott Warner. He commented that he recently counted 13 <br />vehicles owned by the neighbor at 411 Lewis. He requested the Council's assistance in <br />dealing with the problem. <br /> <br />Harold Perez, San Leandro resident, addressed the City Council, requesting clarification on <br />the monthly cost of the red light camera enforcement program. He commented regarding <br />similar problems in his neighborhood with garbage and parked cars. <br /> <br />6. CITY MANAGER AND CITY ATTORNEY REPORTS AND COMMENTS <br /> <br />City Manager Jermanis commented that Councilmember Stephens has alerted the City to the <br />problems at 411 Lewis Avenue. Mr. Jermanis commented on the City's inability to cite or <br />tow vehicles that are properly registered. He indicated that staff is looking into the possibility <br />of adopting amendments to the City's local ordinance to allow the Police Department to cite <br />the types of nuisances that were reported tonight. Mr. Jermanis noted that currently, the City <br />cannot enforce any problems that are not visible from the public right-of-way, but can enlist <br />the assistance of the Alameda County Health Department when a serious health threat exists. <br />He indicated that the City has an ordinance requiring all households to have garbage service <br />and will check with ACI to determine whether the resident at 411 Lewis is in compliance. <br /> <br />City Attorney Williams commented that the California Vehicle Code generally preempts the <br />City from enacting laws to regulate operable vehicles parked on public streets. However, the <br />cities of Oakland and Stockton have adopted local ordinances to abate vehicles considered to <br />be public nuisances. Ms. Williams noted that, based on the pictures that were presented, there <br />maybe opportunities for abatement and enforcement of some of the vehicles. <br /> <br />Mr. Jermanis suggested that it might be beneficial to hold a City Council work session on the <br />subject of strengthening the City's Community Preservation Ordinance. He indicated that he <br />will discuss the Lewis Avenue situation with the Police Chief to determine what current <br />enforcement measures can be taken. <br /> <br />Councilmember Nardine asked whether State law can be used to address an individual who <br />becomes a danger to himself or others. She pointed out the recent tragedy that occurred when <br />three boys became trapped and died in the trunk of an abandoned vehicle and expressed <br />concerns that junk and vehicles on the subject property could pose a dangerous situation. Ms. <br />Williams indicated that the Police Department or the Alameda County Social Services <br />Agency could make the assessment as to whether the individual meets the criteria under <br />Section 5150 of the Welfare and Institutions Code.
