<br />B. Forfeiture of Deductions <br /> <br />If the balance of an employee's wages, after all other involuntary and insurance <br />premium deductions are made in anyone pay period, is not sufficient to pay <br />deductions by this article, no such deductions shall be made for that period. <br /> <br />C. Financial Documentation <br /> <br />1) The Union shall, within sixty (60) days after the end of each fiscal year, make <br />available to the City financial documentation, which shall meet the requirements <br />of Govemment Code section 3502.2. <br /> <br />2) The City agrees to provide the Union the name, department, class, and payroll <br />deduction status of all unit employees on a monthly basis. <br /> <br />D Petition, Election and Challenge <br /> <br />1) If a petition is filed with the City which represents an election rescinding agency <br />shop and such petition contains signatures collected within a forty-five (45) day <br />period, of at least thirty percent (30%) of the employees in the bargaining unit, <br />an election will be held. Such election may be held only once during the term <br />of this Agreement. The verification of the petition and the election shall be <br />conducted by State Conciliation Service. Voting shall be by secret ballot, and a <br />majority vote of all employees in the bargaining unit shall be required to rescind <br />agency shop. <br /> <br />2) A unit employee who is subject to the payment of an agency shop fee hereunder <br />has certain legal rights to object to that part of the fee payable by him or her <br />which represents the employee's additional pro-rata share of expenditures by <br />the Union that is utilized for expenditures not incurred for the purpose of <br />performing the duties incident to effective representation in employer-employee <br />relations. An employee wishing to exercise these rights must contact the Union. <br /> <br />E. Hold Harmless <br /> <br />The Union agrees to indemnify and defend the City and its officers, employees and <br />agents against all claims, proceeding and liability arising, directly or indirectly, out of <br />any actions taken or not taken by or on behalf of the City under this Section. In <br />addition, the Union shall refund to the City of San Leandro any amounts paid to or <br />upon presentation of supporting evidence. <br /> <br />Section 3. Advance Notice <br /> <br />Except in cases of emergency as provided in this section, the City Council and boards and <br />commissions designated by law or by the City Council, shall give reasonable written notice <br />to the Union of any ordinance, rule, resolution or regulation directly relating to matters <br />within the scope of representation, including matters subject to consultation, proposed to be <br />adopted by the City Council or such boards and commissions and shall give such <br />recognized Union the opportunity to meet with the City Council or such boards and <br />commissions. The Union shall give reasonable written notice to the Municipal Employee <br /> <br />3 <br /> <br />
